| Abstrak (Bhs. Indonesia) | Pemutusan Hubungan Kerja (PHK) merupakan upaya terakhir yang dilakukan oleh pengusaha kepada pekerja, segala upaya yang dilakukan pengusaha sebelum melakukan PHK terhadap pekerja harus sesuai dengan prosedur dalam Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan (UU 13/2003) tak terkecuali bagi Tenaga Kerja Asing (TKA). TKA dapat dipekerjakan di Indonesia dengan Perjanjian Kerja Waktu Tertentu (PKWT), terhadap PKWT tersebut sering terjadi pelanggaran oleh pengusaha yakni PHK secara sepihak sebelum jangka waktu perjanjian berakhir. Sehingga, tujuan dari penelitian ini adalah mengetahui dan mengkaji pertimbangan hukum hakim dalam mengeluarkan Putusan Nomor 347 K/PDT.SUS-PHI/2020 tentang PHK terhadap TKA secara sepihak oleh pengusaha dan perlindungan hukum bagi TKA yang terkena PHK di Indonesia. Metode pendekatan yang digunakan dalam penelitian ini adalah metode yuridis normatif, spesifikasi penelitian yang digunakan adalah deskriptif, sumber bahan hukum bahan hukum primer dan bahan hukum sekunder dengan metode penyajian data adalah deskriptif kualitatif serta metode analisis data menggunakan kualitiatif. Berdasarkan hasil penelitian menunjukan bahwa pertimbangan hukum hakim yang menyatakan bahwa pemohon kasasi yaitu pihak pengusaha yang mengakhiri hubungan kerja sebelum jangka waktu berakhirnya perjanjian kerja diwajibkan membayar ganti rugi kepada TKA sebesar gaji TKA sampai batas waktu berakhirnya IMTA tidak sesuai dengan peraturan perundang-undangan di bidang ketenagakerjaan dan perlindungan hukum bagi TKA yang terkena PHK di Indonesia berdasarkan Pasal 62 UU 13/2003 serta TKA memiliki hak yang sama dengan tenaga kerja dalam negeri untuk mengajukan gugatan ke PHI dan Mahkamah Agung. Inggris) | Termination of Employment (layoffs) is the last effort made by the company to workers, all efforts made by the company before laying off workers must be in accordance with the procedures in Law No. 13 of 2013 on Manpower (Law 13/2003) is no exception for foreign workers. Foreign workers can be employed in Indonesia with a Certain Time Work Agreement, against the Certain Time Work Agreement there is often a violation by the company, namely layoffs unilaterally before the term of the agreement expires. Therefore, the purpose of this study is to find out and review the legal considerations of judges in issuing Decree No. 347 K / PDT. SUS-PHI/2020 on layoffs against foreign workers unilaterally by employers and legal protection for foreign workers affected by layoffs in Indonesia. The approach method used in this study is a normative juridical method, the research specification used is descriptive, the source of legal materials of primary legal materials and secondary legal materials with data presentation method is qualitative descriptive as well as data analysis methods using qualitative. Based on the results of the research shows that the legal consideration of the judge who states that the applicant of cassation is the employer who ended the employment relationship before the period of expiration of the employment agreement is obliged to pay compensation to foreign workers in the amount of foreign workers salary until the deadline of expiration of IMTA not in accordance with with the laws and regulations in the field of employment and legal protection for foreign workers affected by layoffs in Indonesia under Article 62 of Law 13/2003 and foreign workers has the same rights as domestic workers to file a lawsuit to PHI and the Supreme Court.
