| Abstrak (Bhs. Indonesia) | Pemberian wewenang yang besar kepada kabupaten/kota dimaksudkan untuk mendekatkan pelayanan kepada masyarakat. Unit pemerintahan ini paling dekat dengan masyarakat, sehingga lebih menguasai permasalahan-permasalahan di daerahnya dibandingkan dengan pemerintah provinsi apalagi pemerintah pusat. Oleh karena itu dengan pendelegasian wewenang yang besar kepada unit pemerintahan yang paling dekat dengan masyarakat, diharapkan permasalahan-permasalahan yang muncul di masyarakat akan mendapat penanganan secara cepat dan akurat. Untuk itulah maka penelitian ini mencoba menganalisis pelaksanaan asas desentralisasi menurut UU No. 32 Tahun 2004 tentang Pemerintahan Daerah. Berdasarkan hasil penelitian dan pembahasan, maka dapat disimpulkan bahwa desentralisasi menurut UU No. 32 Tahun 2004 tentang Pemerintahan Daerah dilaksanakan dengan cara menyerahkan urusan atau wewenang pemerintahan dari Pemerintah Pusat kepada Pemerintah Daerah untuk menjadi urusan atau wewenang Pemerintah Daerah dalam sistem Negara Kesatuan Republik Indonesia. Adapun penyerahan urusan pemerintahan dari Pemerintah Pusat kepada Pemerintah Daerah tersebut mencakup urusan wajib dan urusan pilihan. Urusan wajib yang menjadi kewenangan pemerintahan daerah kabupaten/kota merupakan urusan dalam skala kabupaten/kota yang meliputi 16 (enam belas) urusan wajib, sebagaimana ditegaskan dalam Pasal 14 ayat (1) UU No. 32 Tahun 2004, sedangkan urusan pemerintahan kabupaten/kota yang bersifat pilihan meliputi urusan pemerintahan yang secara nyata ada dan berpotensi untuk meningkatkan kesejahteraan masyarakat sesuai dengan kondisi, kekhasan, dan potensi unggulan daerah yang bersangkutan, sebagaimana ditegaskan dalam Pasal 14 ayat (2) UU No. 32 Tahun 2004. |

Inggris) | THE IMPLEMENTATION OF DECENTRALIZATION PRINCIPLE ACCORDING TO THE LAW NO. 32 IN 2004 ABOUT THE REGIONAL GOVERNMENT The giving big authority to regency/city is intended to make close the service to the society. This government unit is the closest to the society, so it is more easy to take care the problems in their society than with the province government of central government. Because of that with the delegation of big authority to the government unit that is closest in the society, it hopefully can take care faster and accurate the problem that emerges in the society. Because of that this research tries to analyze the implementation of the decentralization principle according to The Law No. 32 in 2004 about the Regional Government. Based on the result of research and discussion, so it can be concluded that the decentralization according to The Law No. 32 in 2004 about the Regional Government it is conducted by giving the business and authority of the government from the Central government to the Regional Government to become the business of authority of regional government in the system of The Unite Nation of Republic OF Indonesia. And the giving of the government matters from the Central Government to the Regional Government involves the obligation affairs and optional affairs. The obligation affairs that become the authority of regional government of regency/city it is the affairs in the regency/city scale that involves 16 (sixteen) obligation affairs, as explained in the Article 14 (1) The Law No. 32 in 2004, and the government affairs of regency/city that has the optional characteristic involves the government affairs that in real exist and has potential to increase the public prosperity based on the condition, specification ,and potential advantages in regional, as explained in the Article 14 (2) No. 32 in 2004.
