| Abstrak (Bhs. Indonesia) | Jalan adalah salah satu sarana peningkatan pelayanan publik terhadap masyarakat. Mengingat pentingnya jalan, maka lahirlah Undang-Undang Nomor 22 Tahun 2009 tentang LLAJ. Salah satu kewajiban penyelenggara jalan adalah memperbaiki dan terus meningkatkan kualitas jalan, namun sampai saat ini masih banyak jalan yang rusak. Sehingga muncul permasalahan yaitu bagaimana pertanggungjawaban pemerintah terhadap jalan rusak tersebut. Metode pendekatan yang digunakan dalam penelitian yaitu metode pendekatan yurudis normatif yang disajikan dalam bentuk teks deskriptif secara sistematis sebagai kesatuan yang utuh. Penyelenggara jalan, baik jalan nasional, provinsi maupun kabupaten/kota apabila melakukan perbuatan yang memenuhi unsur Pasal 273 UU No. 22 Tahun 2009 yaitu karena kelalaiannya tidak segera melakukan perbaikan jalan yang rusak, yang berakibat pada terjadinya kecelakaan maka dapat dimintakan pertanggungjawaban. |
| Abtrak (Bhs. Inggris) | The road is one means of improving public services to the community. Given the importance of the road, then comes the Law No.22 of 2009 about Traffic And Road Transport. One of the obligation of the organizers is to improve and continue to improve the quality of the road, but until now there are many roads were damage. So it appears the problem is how the government accountable to the damaged roads. The method use in the research of normative juridical approach in the form of descriptive text systematically as unified whole. Organizers road, both national, provincial, and district/city if the acts that meet the elements of article 273 Law No. 22 of 2009 which is because the negligence didn’t immediately repair the damaged road, which results in an accident, it can be held accountable.
