Indonesia) | ABSTRAK PERANCANGAN PERATURAN DAERAH BERDASARKAN UNDANG-UNDANG NOMOR 12 TAHUN 2011 TENTANG PEMBENTUKAN PERATURAN PERUNDANG-UNDANGAN Oleh: RIZKI PRABAYANTI EIA009002 Pembentukan Peraturan Daerah, merupakan kekuasaan DPRD untuk mengajukan Rancangan Peraturan Daerah, sedangkan Kepala Daerah sebatas pada ”mempunyai hak” untuk mengajukan Rancangan Peraturan Daerah. Berdasarkan hal tersebut maka tujuan dari penelitian ini adalah tujuan yang ingin dicapai dalam penelitian ini adalah untuk menganalisis perancangan Peraturan Daerah berdasarkan UU No. 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan. Penelitian ini menggunakan metode pendekatan yuridis normatif, dengan spesifikasi penelitian deskriptif dan sumber data adalah data sekunder. Adapun metode pengumpulan data dengan mempelajari peraturan perundang-undangan, buku-buku literatur, dokumen dan putusan pengadilan atau yurisprudensi yang berkaitan dengan obyek atau materi penelitian kemudian dianalisis secara normatif kualitatif. Berdasarkan hasil penelitian dan pembahasan, maka disimpulkan bahwa perancangan Peraturan Daerah melalui 2 (dua) tahap awal, yang satu sama lain saling berkaitan, yaitu: pertama penyusunan Program Legislasi Daerah, meliputi: penyusunan Program Legislasi Daerah di Lingkungan DPRD yang Disusun oleh Badan Legislasi Daerah kemudian disampaikan kepada Pimpinan DPRD untuk diambil keputusan dalam rapat paripurna DPRD dan penyusunan Prolegda di Lingkungan Pemerintah Daerah yang disusun oleh Biro Hukum Provinsi/Bagian Hukum Kabupaten/Kota dan disampaikan kepada Kepala Daerah. Kedua, penyusunan Rancangan Peraturan Daerah, yaitu Rancangan Peraturan Daerah yang berasal dari DPRD yang disusun oleh anggota DPRD, komisi, gabungan komisi, Badan Legislasi Daerah. Kemudian dimusyawarahkan dalam rapat paripurna DPRD untuk mendapatkan persetujuan, kemudian disampaikan kepada Kepala Daerah untuk dilakukan pembahasan. Rancangan Peraturan Daerah yang berasal dari Kepala Daerah yang disusun oleh Pimpinan SKPD dan dikoordinasikan oleh Biro/Bagian Hukum, kemudian disampaikan kepada pimpinan DPRD untuk dilakukan pembahasan. |

Inggris) | ABSTRACT THE DESIGNING OF REGIONAL REGULATION BASED ON THE ORDINANCE NUMBER 12 IN 2011 ABOUT THE ESTABLISHMENT OF ORDINANCE REGULATION BY: RIZKI PRABAYANTI EIA009002 The establishment of Regional Regulation is the authority of DPRD to propose the Designing of Regional Regulation, and the Head of Regional just has the right to propose the Design of Regional Regulation. Based on that explanation so the purpose of research that w ant to be achieved in this research is to analyze the design of regional regulation based on UU No. 12 in 2011 about the Establishment of Ordinance Regulation. This research uses the method of normative juridical, with the descriptive research specification and data source is the secondary data. And the method of collecting data by learning the regulation of ordinance, literature book, document and court decision or jurisprudence which related with the object or material in the research then analyzed normatively and qualitatively. Based on the result of research and discussion, so it can be concluded that the Designing of Regional Regulation through (two) early step which one each other are related, first the designing of Regional Legislation Program involves the designing of Regional Legislation Program in the area of DPRD that designed by Regional Legislation Board then it is explained to the Head of DPRD to be taken the decision in the Paripurna meeting of DPRD and the designing of Prolegda in the Area of Regional Government is designed by the Province Law Biro/Part of Regency/City Law and explained to the Head of Regional. Second, arrangement of the Designing of Regional Regulation that is the Designing of Regional Regulation that come from DPRD that created by the member of DPRD, Commission, integration of commission, Regional Legislation Board. Then discussed together in the Paripurna meeting of DPRD to obtain the agreement , then explained to the Head of Regional to be conducted the discussion. The Designing of Regional Regulation that comes from the Head of Regional that arranged by Head of SKPD and coordinated with the Biro/Law Department, then explained to the Head of DPRD to be conducted the discussion. |
