Indonesia) | ABSTRAK PENINGKATAN FUNGSI DPRD DALAM PENYELENGGARAAN PEMERINTAHAN DAERAH Oleh : SABRINA MARIA GORETTY EIA009036 Pelaksanaan fungs-fungsi DPRD dirasa belum optimal, baik pada fungsi legislasi, anggaran maupun pengawasan. Berdasarkan hal tersebut, maka penelitian ini berusaha untuk menganalisis upaya peningkatan fungsi DPRD Kabupaten/Kota dalam penyelenggaraan pemerintahan daerah. Penelitian ini menggunakan metode yuridis normatif dengan metode pendekatan perundang-undangan (statute approach), spesifikasi penelitian adalah deskriptif analitis, sedangkan sumber bahan hukum yang digunakan adalah bahan hukum primer dan bahan hukum sekunder yang dikumpulkan melalui identifikasi dan inventarisasi terhadap peraturan perundang-undangan dan buku kepustakaan serta dianalisis dengan metode normatif kualitatif. Berdasarkan hasil penelitian dan pembahasan, maka dapat disimpulkan bahwa fungsi legislasi DPRD adalah tugas dan wewenang DPRD untuk membentuk Peraturan Daerah yang dibahas dengan kepala daerah untuk mendapat persetujuan bersama. Fungsi anggaran DPRD merupakan pelaksanaan tugas dan wewenang DPRD dalam penyusunan dan penetapan Anggaran Pendapatan dan Belanja Daerah bersama-sama Pemerintah Daerah. Fungsi pengawasan DPRD dilakukan terhadap pelaksanaan peraturan daerah, peraturan perundang-undangan lainnya, dan keputusan-keputusan yang bukan peraturan perundang-undangan, pengawasan pelaksanaan APBD, pengawasan pelaksanaan kerjasama internasional, dan pengawasan terhadap Kepala Daerah dan Wakil Kepala Daerah. Pelaksanaan ketiga fungsi tersebut belum optimal karena kemampuan sumber daya manusia anggota DPRD yang belum bisa mendukung tugas dan fungsinya. Untuk itu, upaya yang dilakukan adalah melalui orientasi dan pendalaman tugas dan fungsi sebagai anggota DPRD dengan menyelenggarakan bimbingan teknis (Bimtek), workshop (lokakarya)Seminar/Sosialisasi/Semiloka, sebagaimana diatur dalam Peraturan Menteri Dalam Negeri Nomor 34 Tahun 2013 tentang Pedoman Orientasi dan Pendalaman Tugas Anggota DPRD Provinsi dan DPRD Kabupaten/Kota dan ditindaklanjuti dengan Surat Edaran Menteri Dalam Negeri Nomor 160/3559/SJ Tahun 2013 tentang Petunjuk Teknis Orientasi Dan Pendalaman Tugas Anggota DPRD Provinsi dan Dprd Kabupaten/Kota |

Inggris) | ABSTRACT THE INCREMENT OF DPRD FUNCTION IN THE IMPLEMENTATION OF REGIONAL GOVERNMENT By: SABRINA MARIA GORETTY EIA009036 The implementation of DPRD functions is not being optimal yet whether in the legislation function, budgeting or controlling. Based on that explanation, so this research tries to analyze the increment effort of DPRD functions in Regency/City in the implementation of regional government. The method of approach that is used in this research is the approach of normative juridical, and specification of descriptive research, and the source of law material in this research includes the material of primary law and secondary law that collected with doing the literature study and documentation study then analyzed by using the method of qualitative normative. Based on the result and discussion of research, so it can be concluded that the function of DPRD legislation is the duty and authority of DPRD to make the Regional Regulation that is discussed with the head of regional to obtain the agreement together. The budgeting function of DPRD is the implementation of duty and authority of DPRD in arranging and determining of Income budget and regional budget together with the Regional Government. Controlling function of DPRD is conducted to the implementation of regional regulation, other ordinance regulation, and the decisions that is not part of the ordinance regulation, controlling implementation of APBD, controlling implementation of international cooperation, and controlling to the Head and Vice of Regional. The implementation of these three function are not optimal yet because the ability of human resource of DPRD members to support their function and duty. Because of that, the efforts that need to be conducted is through the orientation and exploring the duty and function as the DPRD member by implementing the technical guidance (Bimtek), workshop (Lokakarya), Seminar/Socialization/Semiloka where they are regulated in the Ministry Regulation Number 34 in 2013 about the Guidance of Orientation and Exploration of duty of the DPRD Member in Province and DPRD in Regency/City and followed up by the Domestic Ministry Letter Decision Number 160/3559/SJ in 2013 about the Technical Guidance of Orientation and exploration of duty of the DPRD Member in Province and DPRD in Regency/City. |
