| Abstrak (Bhs. Indonesia) | ABSTRAK Penelitian ini berjudul Tinjauan Yuridis Tentang Perlindungn Hak Asasi Manusia bagi Nelayan di Kabupaten Cilacap. Tujuan penelitian ini adalah untuk menganalisis bentuk perlindungan Hak Asasi Manusia bagi nelayan Kecamatan Cilacap Selatan di KabupatenCilacap. Metode pendekatan yang digunakan dalam penelitian ini adalah penelitian yuridis normatif yaitu penelitian yang difokuskan untuk mengkaji penerapan kaidah-kaidah atau norma-norma dalam hukum positif, dengan pendekatan perundang-undangan (statute approach) yaitu peneliti melihat hukum sebagai sistem tertutup yang mempunyai sifat-sifat comprehensive, all-inclusive dan systematic. Berdasarkan hasil penelitian dapat disimpulkan bentuk perlindungan Hak Asasi Manusia bagi nelayan Kecamatan Cilacap Selatan di Kabupaten Cilacap meliputi : Hak memperoleh kepastian hukum, sesuai Instruksi Presiden Nomor 15 Tahun 2011 tentang Perlindungan Nelayan yang menjamin penegakan hukum di perikanan bagi nelayan. Hak memperoleh penghidupan yang layak, sesuai Pasal 1 (11) UU No 31 Tahun 2004 disebutkan nelayan yang hanya mencari ikan untuk kebutuhan hidupnya sehari-hari. Ayat ini memberikan jaminan bagi nelayan untuk memperoleh penghidupan yang layak dari mata pencaharian mencari ikan. Hak untuk berserikat, dengan dibentuknya Himpunan Nelayan Seluruh Indonesia (HNSI) tanggal 21 Mei 1973. Hak penguasaan wilayah laut, sesuai Pasal 18 Undang-undang No. 27 Tahun 2007 tentang pengelolaan wilayah pengusahaan perairan pesisir atau PWP3. Sebagian besar nelayan di Cilacap tidak memahami hak-haknya sebagai nelayan. Oleh karena itu pihak-pihak terkait, terutama HNSI seharusnya mengupayakan perlindungan hukum bagi nelayan dalam memperoleh hak-haknya. | Abtrak (Bhs. Inggris) | ABSTRACT This study is entitled “Judicial review on the protection of human rights for fishermen in Cilacap” . The aim of this study was to determine the form of human rights protections for fishermen at South Cilacap district, Cilacap regency. The method of approach employed in this study was a normative yuridiction research denoted a research that primarily focus on reviewing the implementation of the rules or norms in positive law, it was carried out through legislation approach (statute approach) where the researcher perceives law as a closed system, which is attributed with comprehensive, all-inclusive and systematic natures. Based on the results of this study, it was concluded that the forms of human rights protection for fishermen at South Cilacap district, Cilacap regency were the right to obtain legal certainity, according Presidential Decree No. 15 year 2011 concerning the protection of the fisherman, which guarantee the law enforcement in fishery for fishermen. Right to a decent living, in accordance with Article 1 (11) of Law No. 31 year 2004 that mentions fishermen as a person whose way of living is fish catching. This verse gives a guarantee for fishermen to procure a decent living from fishing. The right to organize, with the establishment of Indonesian Fishermen Association (HNSI) on May 21, 1973. The governace of marine protected areas, in accordance with Article 18 of Law No. 27 year 2007 concerning the management of the operation area of coastal waters or PWP3. Most fishermen in Cilacap don’t have a comprehension toward their rights as a fisherman. Therefore, the parties concerned in this matter, especially HNSI should seek legal protection for fishermen in obtaining their rights.
