| Abstrak (Bhs. Indonesia) | Tindak Pidana Korupsi merupakan serious crime dan scandal crime sehingga mempunyai tempat khusus dalam pemberantasannya. Tindak pidana ini semakin berkembang dan terorganisir sehingga perlu ada langkah strategis untuk mempercepat pengungkapan tindak pidana terorganisir. Justice collaborator adalah salah satu solusi dalam mengungkap kejahatan terorganisir seperti tindak pidana korupsi. Penelitian ini bertujuan untuk mengetahui mengapa terdakwa Agus Condro dikatakan sebagai justice collaborator dalam Putusan Nomor 14/ Pid.B/ Tpk/ 2011/ PN.Jkt.Pst dan kekuatan pembuktian justice collaborator dalam persidangan sebelum hakim dengan pertimbangannya menjatuhkan Putusan Nomor 14/ Pid.B/ Tpk/ 2011/ PN.Jkt.Pst Penelitian ini menggunakan metode pendekatan Yuridis Normatif yaitu dengan cara menelaah bahan pustaka (data sekunder) yang ada. Metode analisis yang digunakan dalam penelitian ini adalah normatif kualitatif yaitu dengan mengolah dan menafsirkan berdasarkan pada Putusan maupun Perundang-undangan yang berkaitan dengan Penelitian. Penelitian yang dilakukan dari Putusan Nomor 14/ Pid.B/ Tpk/ 2011/ PN.Jkt.Pst diperoleh hasil sebagai berikut : Agus Condro dikatakan sebagai seorang justice collaborator karena memenuhi pedoman justice collaborator yaitu seorang yang bersangkutan merupakan salah satu pelaku tindak pidana kejahatan yang dilakukannya, bukan pelaku utama dalam kejahatan tersebut serta memberikan keterangan sebagai saksi dalam proses peradilan diatur dalam Pasal 9 Huruf a SEMA Nomor 4 Tahun 2011. Dalam Putusan Nomor 14/ Pid.B/ Tpk/ 2011/ PN.Jkt.Pst kekuatan pembuktian justice collaborator sebagai alat bukti saksi yang diatur di Pasal 184 KUHAP berdasar peraturan bersama Peraturan Bersama LPSK, KPK, Kejaksaan Agung, Kepolisian, dan Kementerian Hukum dan HAM bahwa justice collaborator dikatakan sebagai keterangan saksi yang dihadirkan di dalam pengadilan. |
| Abtrak (Bhs. Inggris) | The criminal act, corruption is considered as a serious crime dan scandal crime ,it has its own special place in its eradication. This particular crime is growing and organized so that there is a need for a strategic move to accelerate the disclosure of the organized criminal act. Justice collaborator is one of the few solution in disclosure of the organized criminal act such as corruption. The purpose of this study is to find out why the defendant, Agus Condro is said to be the justice collaborator in the Putusan Nomor 14/ Pid.B/ Tpk/ 2011/ PN.Jkt.Pst and the strength of the justice collaborator the trial before the judge with the consideration dropping the Putusan Nomor 14/ Pid.B/ Tpk/ 2011/ PN.Jkt.Pst. This research is using the method of approach by Yuridis Normatif which is by examining the available journals (secondary data) . The method of analysis which is used in this research are normative and qualitative, which is by processing and interpreting the data based on judgment or legislation relating to this research. The research conducted from the Putusan Nomor 14/ Pid.B/ Tpk/ 2011/ PN.Jkt.Pst has the results as follows : Agus Condro is claimed to be the justice collaborator he has fulfilled his guidelines of a justice collaborator which is, the person involved is considered as one of the perpetrators of criminal acts that he did, not the main actor in the crime and testified as a witness in the judicial process set in Pasal 9 Huruf a SEMA Nomor 4 Tahun 2011. Dalam Putusan Nomor 14/ Pid.B/ Tpk/ 2011/ PN.Jkt.Pst which is the strength of evidence from the justice collaborator as an evidence of witness which is set in Pasal 184 KUHAP under joint regulations of LPSK, KPK, Kejaksaan Agung, Kepolisian, dan Kementerian Hukum dan HAM that the justice collaborator is considered as witness testimony presented in court. |
