| Abstrak (Bhs. Indonesia) | Perkembangan anak menjadi hal yang penting untuk diperhatikan. Negara sebagai tempat berlindung warganya harus dapat memberikan regulasi jaminan perlindungan terhadap hak-hak anak. Keadilan sangat sekali diperhatikan dalam pelaksanaan penegakan hukum. Diantaranya adalah dalam proses peradilan pelaku tindak pidana anak, perhatian tersebut tidak hanya dari ahli hukum (pidana) tetapi juga pada masyarakat dan pemerintah yang ikut serta dalam hal ini. Perlindungan yang diberikan untuk melindungi hak-hak anak merupakan salah satu hal yang menarik untuk diperhatikan Permasalahan dan tujuan penelitian yang diambil antara lain: mengetahui dan menganalisis bentuk implementasi perlindungan hak-hak anak sebagai pelaku tindak pidana di wilayah hukum Pengadilan Negeri Purwokerto. Mengetahui dan menganalisis peranan advokat dalam memberikan bantuan hukum terhadap anak sebagai pelaku tindak pidana di wilayah hukum Pengadilan Negeri Purwokerto. Dalam penelitian ini metode penelitian yang digunakan adalah metode pendekatan yuridis sosiologis dengan spesifikasi penelitian deskriptif. Data yang digunakan adalah data primer dan data sekunder. Hasil penelitian mengungkapkan bentuk penerapan perlindungan hak-hak anak masih belum terlaksana dengan maksimal. Masih terdapat kelemahan dalam penegakan hukumnya yang berpengaruh terhadap kualitas penanganan perkara pidana anak. Peran Advokat dalam memberikan bantuan hukum terhadap anak sebagai pelaku tindak pidana masih kurang maksimal. Terkadang Advokat ditunjuk oleh hakim untuk mendampingi anak pada saat perkara sudah memasuki tahap di pengadilan. Hal ini mengakibatkan advokat menjadi tidak dapat bekerja dengan maksimal karena tidak cukup waktu untuk mencari informasi dan bukti yang meringankan untuk kepentingan pembelaannya. |
| Abtrak (Bhs. Inggris) | Child development becomes important to note . Country as a refuge for citizens should be able to provide regulatory protection for children's rights . Justice so once considered in the implementation of law enforcement . Among them was in the process of criminal justice child , the attention not only of lawyers ( criminal ) but also on society and government who participated in this. The protection provided to protect the rights of children is one of the interesting things to note. Problems and research objectives are taken include: identify and analyze an implementation of the protection of the rights of children as perpetrators of crime in the jurisdiction of the District Court of Purwokerto . Knowing and analyzing the role of lawyers in providing legal assistance to children as perpetrators of crime in the jurisdiction of the District Court of Purwokerto The method used in this study is socio-juridical approach to the specification of a descriptive study . The data used are primary data and secondary data . The results reveal the form of the application of the protection of children's rights is still not performing optimally. There is a weakness in the enforcement of laws that affect the child's quality of handling criminal cases . Advocate role in providing legal assistance to children as criminals is still less than the maximum . Advocates sometimes appointed by judges to accompany the child at the time the case has entered the stage in court . This has led to advocate being unable to work with the maximum due to insufficient time to seek information and evidence which supported the interests of defense .
