| Abstrak (Bhs. Indonesia) | Kejahatan dapat terjadi tidak terlepas dari peran pelaku maupun korban. Tindak pidana pembunuhan berencana dengan unsur penyertaan yang diatur dalam Pasal 340 KUHP jo Pasal 55 ayat (1) ke 1 merupakan salah satu bentuk tindak pidana kejahatan. Korban dalam terjadinya tindak pidana pembunuhan berencana dapat memainkan berbagai peran. Menurut Iswanto, dalam pandangan viktimologi peran korban hendaknya dipertimbangkan sebagai dasar penentuan pertanggungjawaban korban dan menentukan berat ringannya pidana yang dijatuhkan kepada para terdakwa. Dalam perkara Nomor : 23/Pid.B/2010/PN.Bms, korban berperan sebagai participating victim maupun provocative victim. Hakim sebagai pihak yang memiliki wewenang memutus dan mengadili perkara pidana harus menggali, mengikuti, dan memahami nilai-nilai hukum dan rasa keadilan yang hidup dalam masyarakat. Keadilan menurut Iswanto adalah keseimbangan perhatian dan perlakuan terhadap setiap orang yang memiliki syarat- syarat yang sama yang terpancar dalam setiap putusan hakim. Dalam Putusan Pengadilan Nomor 23/Pid.B/2010 PN.Bms Majelis Hakim tidak mempertimbangkan peran korban sebagai dasar penjatuhan pidana terhadap para terdakwa. Dengan demikian putusan hakim tersebut belum mencerminkan nilai keadilan. |
| Abtrak (Bhs. Inggris) | Crime can occur can’t be separated from the role of the offenders and the victim. Premeditated murder complicity which is regulate in article 340 of the Penal Code jo Article 55 clause 1 point 1 of Penal Code is a form of crime. Victim in the occurrence of a criminal offense premeditated murder can take various roles. According to Iswanto in Victimology point of view, the role of victim should be considered as the basis to determine liability of the victim and determine the weight of penalties imposed to the defendant. In premeditated murder complicity case number: 23/Pid. B/2010/PN/Bms, the victim plays a role as participating victim nor provocative victim. Judges as parties who have the authority to judge and make a decision of criminal cases must explore, follow, and understand the legal values and sense of justice that lives within the society. Justice according to Iswanto is balances attention and treatment for anybody who has same requirements that radiated in every judge decision. In court judgment number 23 / 2010 / Pid.B/ Pn.Bms, the judge did not consider the role of victims as a base for impose the criminal sanction to the defendant. Thus judge decision has not reflected value of justice yet. |
