| Abstrak (Bhs. Indonesia) | ABSTRAKSI Hukum kewarisan adalah hukum yang mengatur tentang pemindahan hak pemilikan harta peninggalan pewaris, menentukan siapa-siapa yang berhak menjadi ahli waris dan beberapa bagian masing-masing. Berdasar penelitian terhadap penetapan No : 0013/Pdt. P/2011/PA.Bms. Pengadilan Agama Banyumas dalam penetapannya terdapat penyimpangan yang dilakukan oleh hakim, yaitu adanya anak yang berbeda agama dengan pewaris, namun hakim menetapkan yang berbeda agama tersebut ditetapkan sebagai ahli waris. Permasalahan mengenai penelitian ini adalah bagaimana hak waris non muslim. Berdasarkan hasil penelitian, dalam pertimbangan hukum hakim memberikan hak waris kepada non muslim. Pertimbangan hakim tersebut tidak sejalan dengan prinsip-prinsip dalam hukum waris Islam, yang didalam hadist Nabi riwayat Bukhari-Muslim : “orang Islam tidak boleh mewaris (harta) orang kafir, dan orang kafir tidak boleh mewaris (harta) orang Islam. Karena dalam hukum Islam non muslim merupakan penghalang untuk menerima waris, yaitu terhalang secara mahrum (kedudukannya yang diharamkan oleh agama Islam). |
| Abtrak (Bhs. Inggris) | ABSTRACT Inheritance law is the law governing the transfer of ownership rights legacy heir, determine who is entitled to be the heir and some parts of each. Based on the study of the determination of No: 0013/Pdt. P/2011/PA.Bms. Religious courts in the establishment there Banyumas irregularities committed by the judge, that is the child of a different religion to the deceased, but the judge set a different religion is designated as heir. Concerns about this study is how the inheritance rights of non-Muslims. Based on this research, in consideration of the law the judge gives inheritance rights to non-Muslims. Consideration of the judge is not in line with the principles of the law of inheritance Isla, who in the hadith narrated by Bukhari-Muslim Prophet: "Muslims should not be heir (treasure) infidels and unbelievers should not be heir (treasure) of Islam. Due to non-Muslims in Islamic law is a barrier to receiving inheritance, which is hindered by mahrum (position is forbidden by Islam). |
