Indonesia) | ABSTRAK Skripsi ini membahas secara normatif mengenai penerapan klausula baku dalam perjanjian usaha jasa laundry yang terdapat dalam nota pembayaran Laundry Central Purwokerto. Beberapa klausula baku tersebut merupakan klausula yang mengalihkan tanggungjawab dan resiko kerugian Laundry Central Purwokerto kepada pengguna jasa Laundry Central Purwokerto. Latar belakang penulisan skripsi ini berawal dari klausula baku yang oleh undang undang tidak diperkenankan untuk dicantumkan dalam perjanjian, tetapi dalam prakteknya klausula tersebut masih selalu digunakan dalam perjanjian yang banyak ditemukan dalam nota pembayaran Laundry Central Purwokerto. Metode pendekatan yang digunakan dalam penelitian ini adalah pendekatan perundang-undangan yang bersifat kualitatif dengan metode yuridis normatif. Pengumpulan data melalui penelitian terhadap sejumlah literatur, diinvetarisasi menurut relavansinya dengan pokok masalah yang diteliti dan kemudian dipelajari sebagai satu kesatuan. Teknik menyajian data disajikan dalam bentuk teks naratif yang disusun secara sistematis sebagai satu kesatuan yang utuh, yang didahului dengan pendahuluan yang berisi latar belakang, tujuan penelitian, tinjauan pustaka, metode penelitian dan diteruskan dengan analisa data dan hasil pembahasan serta diakhiri dengan simpulan. Hasil penelitian yang mengacu pada ketentuan yang berlaku, penerapan klausula baku yang nampak dalam ketentuan yang tertuang dalam nota pembayaran yang dikeluarkan oleh Laundry Central Purwokerto belum dilaksanakan sesuai dengan ketentuan dalam Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen serta dalam ketentuan yang diatur dalam KUHPerdata. Oleh karena itu klausula tersebut batal demi hukum dan pihak Laundry Central Purwokerto wajib menyesuaikan klausula-klausula baku tersebut dengan aturan UUPK. |

Inggris) | ABSTRACT This thesis discuss in normative about the application of the standart contract in the laundry service agreement which contained in the payments note of Central Laundry Purwokerto. Some of those standart contract were a clause which redirect responsibility and loss risk of Central Laundry Purwokerto to the service users of Central Laundry Purwokerto. The background of this thesis writing starting from standart contract which by law are not allowed to be listed in the agreement,but in practice the clause was always used in the agreement are found in the payments note for new admissions Central Laundry. Method of approach used in this study is a qualitative approach to regulations with normative juridical method.The collection of data through research literature,in groups according to their relevance to the subject matter which is examined and then studied as a whole.Technique of presentation of data presented in the form of narrative texts are arranged systematically as one unified whole,that is preceded by an introduction which contains background, research objectives, a review of the literature, research methods and data analysis and the results of the discussion and concludes with a summary. The results of research that refers to the prevailing regulation, the application of raw klausula visible in the provisions stipulated in a payments note that is issued by Central Laundry Purwokerto has not been conducted in accordance with the provisions of the act of number 8 year 1999 on consumer protection as well as in the provision as regulated in the act of civil law. Hence clause is void for the sake of law and the Central Laundry Purwokerto shall be obliged to adjust the clauses raw with the rules of the constitution consumer protection. |
