(Studi Putusan Nomor 2/Pdt.Sus-HKI/Merek/2025/PN Niaga Jkt.Pst )
Abtrak (Bhs. Inggris)This study was prompted by a dispute over the registration of the well-known trademark “HANKE” between Junxiong Deng, as the Plaintiff, and PT HANKE Trading Indonesia, as the Defendant. The Plaintiff filed a petition to cancel the Defendant’s trademark in Class 18 on the grounds that it was substantially similar and had been filed in bad faith. The objective of this study is to examine the legal protection afforded to holders of well-known trademarks and to analyze the legal consequences of trademark cancellation under Law No. 20 of 2016 on Trademarks and Geographical Indications, as reflected in Judgment No. 2/Pdt.Sus-HKI/Merek/2025/PN Niaga Jkt.Pst.
This study employs a normative legal method through legislative, conceptual, and case-based approaches. Data were sourced from a literature review and analyzed qualitatively to be presented in a descriptive-analytical manner.
Based on the findings of the investigation and deliberations, it was concluded that preventive protection through trademark registration had not been optimal, leading the Plaintiff to pursue repressive protection measures. The Panel of Judges ruled that the Defendant’s trademark was proven to be substantially similar visually, phonetically, and conceptually to the Plaintiff’s well-known “HANKE” trademark and had been registered in bad faith to free-ride on its reputation. The Plaintiff was judicially recognized as the owner of the well-known trademark. The Defendant’s trademark was invalidated, thereby forfeiting its exclusive rights, and the Indonesian Directorate General of Intellectual Property was ordered to remove the trademark from the General Trademark Register.
