| Abstrak (Bhs. Indonesia) | Kasus Tindak Pidana Narkotika merupakan salah satu kejahatan luar biasa yang didakwakan melalui dakwaan alternatif dengan tujuan untuk memastikan fleksibilitas dalam pembuktian yang menimbulkan permasalahan jika dakwaan paling ringan diterapkan karena memiliki perbedaan signifikan dalam ancaman pidana. Penelitian ini mengkaji Putusan Nomor 28/Pid.Sus/2023/PN Cianjur terkait tindak pidana narkotika, di mana hakim memilih dakwaan paling ringan kedua Pasal 111 ayat (1) dan menjatuhkan pidana penjara 4 (empat) tahun 6 (enam) bulan. Penelitian bertujuan menganalisis pertimbangan hukum hakim dan implikasi yang ditimbulkan, menggunakan metode yuridis normatif dengan Pendekatan Perundang-undangan, kasus, dan konseptual. Hasil penelitian menunjukkan bahwa majelis hakim menguji secara bertahap dakwaan alternatif Pasal 114 ayat (1) dan Pasal 111 ayat (1) Undang-Undang Narkotika. Unsur perbuatan aktif sebagai perantara jual beli dalam Pasal 114 ayat (1) dinilai tidak terbukti secara sah dan meyakinkan, sehingga hakim memilih dakwaan kedua Pasal 111 ayat (1) karena unsur memiliki, menyimpan, dan menguasai narkotika golongan I terbukti berdasarkan alat bukti yang sah di persidangan. Pertimbangan yuridis dan non-yuridis, termasuk keadaan pribadi dan sosial terdakwa, turut memengaruhi berat ringannya pidana yang dijatuhkan. Pemilihan dakwaan paling ringan ini berimplikasi pada perlindungan hukum dan keadilan individual bagi terdakwa, sekalipun hakim belum menguraikan secara memadai dasar pertimbangan atas tidak diterapkannya Pasal 114 ayat (1), sehingga aspek kepastian hukum dalam putusan ini masih perlu diperkuat. |

Inggris) | Drug-related criminal cases are among the extraordinary crimes charged via alternative charges, with the aim of ensuring flexibility in the presentation of evidence; this creates problems when the lightest charge is applied, as it carries a significantly different criminal penalty. This study examines Judgment No. 28/Pid.Sus/2023/PN Cianjur regarding a narcotics crime, in which the judge selected the second-lightest charge under Article 111(1) and imposed a prison sentence of 4 (four) years and 6 (six) months. The study aims to analyze the judge’s legal reasoning and the resulting implications, using a normative legal method with legislative, case-based, and conceptual approaches. The results show that the panel of judges systematically examined the alternative charges under Article 114(1) and Article 111(1) of the Narcotics Law. The element of active conduct as an intermediary in the sale and purchase under Article 114(1) was deemed not proven beyond a reasonable doubt; consequently, the judges opted for the second charge under Article 111(1) because the elements of possessing, storing, and controlling Schedule I narcotics were proven based on admissible evidence presented in court. Both legal and non-legal considerations, including the defendant’s personal and social circumstances, influenced the severity of the sentence imposed. The choice of the lightest possible charge has implications for the defendant’s legal protection and individual justice, even though the judge has not adequately explained the basis for not applying Article 114(1); thus, the aspect of legal certainty in this ruling still needs to be strengthened. |
