| Abstrak (Bhs. Indonesia) | Concursus adalah keadaan ketika seseorang melakukan lebih dari satu tindak pidana atau satu perbuatan yang memenuhi lebih dari satu ketentuan pidana, sehingga diperlukan pengaturan untuk menentukan penerapan dan penjatuhan pidananya. Penelitian ini bertujuan: Untuk mengetahui penerapan concurcus idealis dalam peristiwa pidana pembunuhan oleh suami terhadap isterinya pada Putusan Pengadilan Negeri Sei Rampah Nomor 89/Pid.B/2025/PN Srh. Kedua Untuk mengetahui penerapan concurcus idealis dalam peristiwa pidana pembunuhan oleh suami terhadap isterinya pada Putusan Pengadilan Negeri Sei Rampah Nomor 89/Pid.B/2025/PN Srh, apa sudah tepat. Penelitian menggunakan pendekatan yuridis normatif, bersifat preskriptif, dengan data sekunder yang dikumpulkan melalui studi kepustakaan, disajikan dalam bentuk uraian dan dianalisis secara normatif kualitatif. Berdasarkan hasil penelitian dan pembahasan, maka dapat disimpulkan sebagai berikut: Penelitian ini membahas penerapan concursus idealis dalam Putusan Pengadilan Negeri Sei Rampah Nomor 89/Pid.B/2025/PN Srh terkait tindak pidana pembunuhan oleh suami terhadap istrinya. Hasil analisis menunjukkan bahwa perbuatan Terdakwa menimbulkan satu rangkaian akibat berupa kematian korban Lisa Putri dan luka berat pada Saksi Suyati, sehingga secara teoritis memenuhi Pasal 340 KUHP dan Pasal 351 ayat (2) KUHP serta konsep concursus idealis sebagaimana Pasal 63 ayat (1) KUHP. Namun, dalam praktiknya Penuntut Umum menggunakan dakwaan kumulatif dan Majelis Hakim menyatakan Terdakwa terbukti melanggar kedua pasal tersebut tanpa menegaskan penerapan asas absorpsi. Di sisi lain, berdasarkan fakta adanya serangkaian tindakan dengan alat dan korban yang berbeda, konstruksi yang lebih tepat adalah concursus realis sebagaimana Pasal 65 KUHP. Dengan demikian, terdapat perbedaan antara konstruksi teoritis dan penerapan dalam putusan terkait konsep concursus dalam perkara tersebut. |

Inggris) | Concursus refers to a situation in which a person commits more than one criminal act or a single act that fulfills more than one criminal provision, thereby requiring legal rules to determine the application and imposition of punishment. This study aims: first, to examine the application of concursus idealis in the criminal act of murder committed by a husband against his wife in the Decision of the Sei Rampah District Court Number 89/Pid.B/2025/PN Srh; and second, to determine whether the application of concursus idealis in the case is appropriate. This research uses a normative juridical approach, is descriptive-prescriptive in nature, and relies on secondary data collected through literature study, presented in descriptive form and analyzed using qualitative normative analysis. The results of the study show that the Defendant’s actions resulted in a single series of consequences, namely the death of the victim Lisa Putri and serious injury to the witness Suyati, which theoretically fulfills Article 340 of the Indonesian Criminal Code and Article 351 paragraph (2) of the Criminal Code, as well as the concept of concursus idealis under Article 63 paragraph (1) of the Criminal Code. However, in practice, the Public Prosecutor applied cumulative charges and the Panel of Judges found the Defendant guilty of violating both provisions without explicitly applying the principle of absorption. On the other hand, based on the facts indicating a series of separate actions involving different instruments and victims, the more appropriate legal construction is concursus realis under Article 65 of the Criminal Code. Thus, there is a discrepancy between the theoretical construction and its application in the court decision regarding the concept of concursus in this case. |
