| Abstrak (Bhs. Indonesia) | Transformasi hukum acara pidana di Indonesia melalui berlakunya KUHAP Baru (UU No. 20 Tahun 2025) membawa perubahan yang signifikan terhadap sistem peradilan pidana, termasuk dalam penguatan kedudukan dan kewenangan advokat yang sebelumnya masih terbatas berdasarkan KUHAP Lama (UU No. 8 Tahun 1981). Penelitian ini bertujuan untuk menganalisis kedudukan dan kewenangan advokat dalam sistem peradilan pidana berdasarkan KUHAP Baru serta mengkaji implikasinya terhadap perlindungan hak tersangka atau terdakwa. Penelitian menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, pendekatan perbandingan, dan pendekatan konseptual, yang didukung oleh data sekunder dan dianalisis secara kualitatif komparatif. Hasil penelitian menunjukkan bahwa KUHAP Baru memberikan kewenangan atributif yang lebih luas kepada advokat, antara lain berupa hak untuk memberikan pendampingan sejak tahap awal pemeriksaan, mengajukan keberatan yang wajib dicantumkan dalam Berita Acara Pemeriksaan, memperoleh perlindungan hak imunitas hingga di luar persidangan, serta memperoleh akses yang lebih luas terhadap berkas perkara. Penguatan tersebut berdampak pada meningkatnya perlindungan hukum, baik secara preventif maupun represif, melalui pengawasan yudisial, kewajiban perekaman proses pemeriksaan dengan CCTV, serta penerapan exclusionary rule, yaitu prinsip yang mengesampingkan alat bukti yang diperoleh secara melawan hukum dari proses pembuktian. Penelitian ini merekomendasikan adanya komitmen seluruh aparat penegak hukum dalam mengimplementasikan KUHAP Baru disertai peningkatan kualitas dan integritas advokat melalui pendidikan serta pelatihan yang berkelanjutan. |

Inggris) | The transformation of criminal procedure law in Indonesia through the enactment of the New Criminal Procedure Code (Law No. 20 of 2025) has brought significant changes to the criminal justice system, including the strengthening of the status and authority of defense attorneys, which had previously been limited under the Old Criminal Procedure Code (Law No. 8 of 1981). This study aims to analyze the status and authority of defense attorneys within the criminal justice system under the New Criminal Procedure Code and to examine its implications for the protection of the rights of suspects or defendants. The study employs a normative legal methodology using legislative, comparative, and conceptual approaches, supported by secondary data and analyzed through a comparative qualitative framework. The results of the study indicate that the New Criminal Procedure Code grants broader attributive powers to defense attorneys, including the right to provide legal representation from the initial stages of questioning, to file objections that must be recorded in the Interrogation Transcript, to receive immunity protection even outside the courtroom, and to have broader access to case files. These enhancements have led to increased legal protection—both preventive and repressive through judicial oversight, the mandatory recording of interrogation processes via CCTV, and the application of the *exclusionary rule*, a principle that excludes evidence obtained unlawfully from the evidentiary process. This study recommends a commitment by all law enforcement officials to implement the New Criminal Procedure Code, accompanied by improvements in the quality and integrity of attorneys through ongoing education and training. |
