Abstrak (Bhs. Indonesia)Perkembangan industri jasa kebersihan hunian memunculkan praktik perjanjian baku
yang lazim digunakan oleh pelaku usaha jasa cleaning service, yang dalam
pelaksanaannya sering kali memuat klausula eksonerasi berupa pembatasan atau
pengalihan tanggung jawab pelaku usaha kepada konsumen. Meskipun Pasal 18
Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen secara tegas
melarang pencantuman klausula semacam itu, pelanggaran dalam praktiknya tetap
terjadi sebagaimana tercermin dalam perkara antara Fransiscus Leo melawan PT
Cakrawala Servis Resolusindo dalam Putusan Pengadilan Negeri Kediri Nomor
33/Pdt.G/2024/PN Kdr. Penelitian ini bertujuan untuk menganalisis perlindungan
hukum bagi konsumen berdasarkan UUPK terhadap klausula eksonerasi dalam Terms
of Service PT CSR, serta mengkaji akibat hukum yang timbul dari putusan tersebut bagi
pelaku usaha. Metode penelitian yang digunakan adalah yuridis normatif dengan
pendekatan perundang-undangan (statute approach), pendekatan kasus (case
approach), dan pendekatan konseptual (conceptual approach). Hasil penelitian
menunjukkan bahwa ketiga klausula dalam Terms of Service PT CSR yakni klausula
pengecualian garansi pada area pasca pembangunan, pembatasan ganti rugi sebesar nilai
pekerjaan harian, dan kewenangan mutlak manajemen dalam menentukan kompensasi
terbukti melanggar Pasal 18 ayat (1) huruf a dan huruf f UUPK, sehingga dinyatakan
batal demi hukum. Perlindungan hukum bagi konsumen dalam perkara ini telah
terwujud secara preventif melalui norma larangan UUPK, dan secara represif melalui
putusan pengadilan yang mengabulkan gugatan Penggugat. Adapun akibat hukum bagi
PT CSR bersifat multidimensional, secara perdata diwajibkan membayar ganti rugi
materiil sebesar Rp103.851.000,00 dan immateriil sebesar Rp100.000.000,00 secara
tanggung renteng; secara administratif diwajibkan menyesuaikan Terms of Service nya
berdasarkan Pasal 18 ayat (4) UUPK; serta berpotensi dikenai sanksi pidana berdasarkan
Pasal 62 ayat (1) UUPK apabila terdapat pengaduan yang ditindaklanjuti.

Abtrak (Bhs. Inggris)The growing residential cleaning service industry has given rise to widespread use of
standard contracts by service providers, which frequently contain exoneration clauses
that limit or transfer the business operator's liability to consumers. Although Article 18
of Law Number 8 of 1999 on Consumer Protection explicitly prohibits the inclusion of
such clauses, violations continue to occur in practice, as evidenced by the dispute
between Fransiscus Leo and PT Cakrawala Servis Resolusindo in Kediri District Court
Decision Number 33/Pdt.G/2024/PN Kdr. This study aims to analyze consumer legal
protection under the Consumer Protection Law against the exoneration clauses
contained in PT CSR's Terms of Service, and to examine the legal consequences arising
from the court's decision for the business operator. The research employs a normative
juridical method with a statute approach, a case approach, and a conceptual approach.
The findings reveal that the three clauses in PT CSR's Terms of Service namely the
warranty exclusion clause for post-construction areas, the limitation of compensation
to the daily service fee, and the absolute authority granted to management in
determining compensation were found to be in violation of Article 18 paragraph (1)
letters a and f of the Consumer Protection Law, and were consequently declared null
and void. Consumer legal protection in this case was realized preventively through the
prohibitive norms of the Consumer Protection Law, and repressively through the court's
decision upholding the plaintiff's claim. The legal consequences for PT CSR are
multidimensional, in civil terms, PT CSR is obligated to pay material damages of
Rp103,851,000.00 and non-material damages of Rp100,000,000.00 jointly and
severally; in administrative terms, PT CSR is required to revise its Terms of Service in
accordance with Article 18 paragraph (4) of the Consumer Protection Law; and
potentially subject to criminal sanctions under Article 62 paragraph (1) of the Consumer
Protection Law should a formal complaint be filed and pursued.
