Abstrak (Bhs. Indonesia)Alam beserta kekayaannya berkontribusi aktif dalam kehidupan umat manusia, khususnya terkait pemanfaatan sumber daya genetik (SDG). Prinsip kedaulatan negara atas SDG-nya menggeser paradigma common heritage of mankind sehingga setiap negara memiliki kedaulatan penuh atas SDG dalam wilayahnya untuk melindungi dari biopiracy. Penelitian ini bertujuan untuk mengetahui prinsip Access Benefit Sharing (ABS) dalam Protokol Nagoya sebagai upaya pencegahan biopiracy serta mengetahui implementasi ABS dalam sistem hukum nasional atas perlindungan varietas tanaman dari biopiracy. Penelitian ini bersifat yuridis normatif dengan metode pendekatan perundang-undangan dan konseptual serta spesifikasi penelitian konsistensi hukum melalui studi kepustakaan dan disajikan melalui teks naratif. Hasil yang diperoleh dari penelitian ini dapat disimpulkan bahwa prinsip ABS diterapkan dalam Protokol Nagoya sebagai bentuk upaya tercapainya keadilan distributif bagi pemulia lokal dan masyarakat adat dari pemanfaatan SDG. Protokol Nagoya yang mengatur pembagian manfaat merupakan langkah preventif dari praktik biopiracy oleh negara maju. Indonesia memiliki Undang-Undang tentang Perlindungan Varietas Tanaman sebagai penghargaan atas pemuliaan tanaman namun belum mengatur pembagian manfaat yang adil. Sejauh ini belum ada undang-undang nasional yang membahas prinsip Access and Benefit Sharing terkait perlindungan varietas tanaman.
Abtrak (Bhs. Inggris)Nature and its wealth actively contribute to human life, particularly regarding the utilization of genetic resources (GR). The principle of state sovereignty over its GR has shifted the paradigm from the common heritage of mankind, ensuring that every country has full sovereignty over the genetic resources within its territory to protect them from biopiracy. This study aims to determine the Access and Benefit Sharing (ABS) principle in the Nagoya Protocol as an effort to prevent biopiracy, as well as to understand the implementation of ABS within the national legal system regarding the protection of plant varieties from biopiracy. This research is a normative juridical study utilizing statutory and conceptual approaches, with a research specification focused on legal consistency through literature review, presented via narrative text. The results obtained from this study indicate that the ABS principle is applied in the Nagoya Protocol as a form of effort to achieve distributive justice for local breeders and indigenous communities from the utilization of GR. The existence of the Nagoya Protocol regulating benefit-sharing serves as a preventive measure against biopiracy practices by developed nations. Indonesia has a Plant Variety Protection Act as an appreciation for plant breeding; however, it has not yet regulated fair and equitable benefit-sharing. There is no national law addressing the principles of Access and Benefit Sharing (ABS) in relation to plant variety protection.
