| Abstrak (Bhs. Indonesia) | Merek adalah bagian dari Hak Kekayaan Intelektual yang berfungsi sebagai tanda pembeda yang menunjukkan asal-usul dan jaminan kualitas suatu produk serta sebagai sarana promosi. Hak atas merek diperoleh ketika merek telah didaftarkan (prinsip first to file). Pembatalan merek penting untuk menjaga kepastian hukum prinsip first to file yang memastikan bahwa hak hanya diberikan pada pendaftaran yang sah sesuai dengan Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis dalam Putusan Nomor 8/Pdt.Sus-HKI/Merek/2025/PN Niaga Jkt Pst. Penelitian menggunakan metode pendekatan yuridis normatif dengan spesifikasi penelitian deskriptif analitis. Sumber data yang digunakan berupa data sekunder. Metode pengumpulan data dilakukan melalui studi kepustakaan yang disajikan dalam bentuk teks naratif serta menggunakan metode analisis data kualitatif. Hasil penelitian dan pembahasan menunjukkan bahwa penerapan prinsip first to file terlihat melalui penerimaan pendaftaran merek Penggugat maupun Tergugat yang secara administratif tidak bertentangan dengan sistem pendaftaran karena perlindungan merek diperbolehkan untuk kelas barang berbeda. Merek “SENSATIA dan SENSATIA BOTANICALS” milik Penggugat dikategorikan sebagai merek terkenal sehingga reputasi merek Penggugat perlu dilindungi. Pendaftaran merek milik Tergugat pada awalnya secara administratif diterima kemudian dinilai tidak memenuhi syarat untuk memperoleh hak atas dasar adanya persamaan pada pokoknya dengan merek terkenal milik Penggugat dan pendaftaran dengan iktikad tidak baik. Unsur iktikad tidak baik mengakibatkan pembatalan merek yang menghapus hak atas merek milikTergugat dan pencoretan merek dari Daftar Umum Merek. |

Inggris) | Trademark is part of Intellectual Property Rights that function as a distinguishing mark indicating the origin and quality assurance of a product, as well as a means of promotions. Trademark rights are obtained when the trademark has been registered (first to file principle). Trademark cancellation is important to mantain the legal certainty of the first to file principle, which ensures that rights are only granted to valid registrations in accordance based on Law Number 20 of 2016 concerning Trademarks and Geographical Indications in Decisions Number 8/Pdt.Sus-HKI/Merek/2025/PN Niaga Jkt Pst. The research uses a normative juridical approach with descriptive analytical research spesifications. The data sources used are secondary data. The data collection method was conducted through a literature study, which was presented in narrative form and using qualitative data analysis methods. The results of the research and discussion show that the application of the first to file principle is evident through the acceptance of the plaintiff’s and Deffendant’s trademark registration, which are not administratively contrary to the registration system because trademark protection is permitted for different classes of goods. “SENSATIA and SENSATIA BOTANICALS” owned by the plaintiff is categorized as a well know trademark. Therefore, the reputation of the Plaintiff’s trademark needs to be protected. The Defendant’s trademark registration was initially accepted administratively but was later deemed ineligible for rights due to its similarity to the plaintiff’s well-known trademark and registration in bad faith. The element of bad faith resulted in the cancellation of the trademark, which revoked the Defendant’s rights to the trademark and removed the trademark from the General Trademark Register. |
