Indonesia) | HAMBATAN IMPLEMENTASI DIVERSI PADA PENANGANAN PERKARA TINDAK PIDANA PENGANIAYAAN OLEH ANAK PELAKU (Studi di Kejaksaan Negeri Purbalingga) Oleh: SHAFIRA ADELIA PUTRI WAHYUDI E1A021207 ABSTRAK Penelitian ini bertujuan untuk mengetahui implementasi dan hambatan dalam implementasi diversi pada penanganan perkara tindak pidana penganiayaan di Kejaksaan Negeri Purbalingga. Penelitian ini menggunakan metode pendekatan yuridis empiris dengan spesifikasi penelitian deskriptif analitis. Jenis data yang digunakan adalah data primer yang diperoleh melalui wawancara dengan Jaksa, Advokat, Anak Pelaku, dan Korban. Data sekunder diperoleh melalui studi kepustakaan terhadap peraturan perundang-undangan. Metode analisis data dalam penelitian ini menggunakan analisis kualitatif. Berdasarkan hasil penelitian, implementasi diversi telah dilaksanakan oleh aparat penegak hukum di Kejaksaan Negeri Purbalingga sesuai dengan ketentuan Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak dan Peraturan Jaksa Agung Republik Indonesia Nomor PER-006/A/JA/04/2015 tentang Pedoman Pelaksanaan Diversi pada Tingkat Penuntutan. Diversi bertujuan untuk mewujudkan keadilan restoratif. Dalam implementasinya, tidak ditemukan hambatan yang berarti dari segi hukum, aparat penegak hukum maupun sarana dan prasarana. Hambatan utama berasal pada faktor masyarakat, yaitu sulitnya mencapai kesepakatan antara anak pelaku dan korban. Hal ini menyebabkan diversi tidak dapat dilanjutkan dan perkara dilimpahkan ke Pengadilan. Hal ini menunjukkan bahwa keberhasilan diversi tidak hanya bergantung pada aturan, fasilitas dan pelaksana hukum, tetapi juga sangat ditentukan oleh partisipasi dan sikap para pihak yang terlibat. |

Inggris) | OBSTACLES TO THE IMPLEMENTATION OF DIVERSION IN HANDLING CASES OF ASSAULT COMMITTED BY CHILD OFFENDERS (A Study at the District Attorney’s Office of Purbalingga) By: SHAFIRA ADELIA PUTRI WAHYUDI E1A021207 ABSTRACT This study aims to determine the implementation and obstacles in the application of diversion in handling assault cases committed by child offenders at the District Attorney’s Office of Purbalingga. This research uses a juridical-empirical approach with a descriptive-analytical research specification. The types of data used are primary data obtained through interviews with prosecutors, defense attorneys, child offenders, and victims. Secondary data were obtained through literature studies of statutory regulations. The data analysis method used in this research is qualitative analysis. Based on the findings, the implementation of diversion has been carried out by law enforcement officials at the District Attorney’s Office of Purbalingga in accordance with the provisions of Law Number 11 of 2012 concerning the Juvenile Criminal Justice System and the Regulation of the Attorney General of the Republic of Indonesia Number PER-006/A/JA/04/2015 concerning Guidelines for the Implementation of Diversion at the Prosecution Stage. Diversion aims to realize restorative justice. In its implementation, no significant obstacles were found in terms of law, law enforcement officers, or facilities and infrastructure. The main obstacle comes from the community, namely the difficulty in reaching an agreement between the child offender and the victim. This causes the diversion process to be discontinued and the case to be submitted to the court. This indicates that the success of diversion not only depends on regulations, facilities, and law enforcement officers, but is also greatly determined by the participation and attitudes of the parties involved. |
