| Abstrak (Bhs. Indonesia) | PERLINDUNGAN HUKUM LEMBAGA PERLINDUNGAN SAKSI DAN KORBAN (LPSK) TERHADAP ANAK KORBAN TINDAK PIDANA PERSETUBUHAN (Studi Putusan Nomor 101/Pid.Sus/2023/PN Bek.) Oleh: WIDYAYANTI AGUSTIN E1A020038 ABSTRAK Tindak pidana persetubuhan terhadap anak merupakan bentuk kejahatan yang memiliki dampak serius, baik secara fisik maupun psikologis terhadap korban. Negara melalui Lembaga Perlindungan Saksi dan Korban (LPSK) memiliki kewenangan memberikan perlindungan hukum, untuk menjamin pemenuhan hak-hak korban. Tujuan dari penulisan skripsi ini adalah untuk mengetahui perlindungan hukum yang diberikan LPSK kepada anak korban dalam Putusan 101/Pid.Sus/2023/PN Bek serta pertimbangan hakim dalam menjatuhkan sanksi restitusi. Metode yang digunakan dalam penelitian ini adalah yuridis normatif yang dalam penelitiannya menggunakan sumber data sekunder berupa regulasi dan referensi. Data yang diperoleh kemudian diolah dan dianalisis menggunakan metode normatif kualitatif dengan spesifikasi penelitian deskriptif analitis. Hasil penelitian menunjukkan bahwa perlindungan hukum LPSK dalam perkara ini terbatas pada pemberian layanan restitusi, sementara hak-hak korban lainnya belum sepenuhnya terpenuhi. Dalam pertimbangan hukum hakim pada Putusan Nomor 101/Pid.Sus/2023/PN Bek salah satu amar putusannya terkait restitusi aspek kerugian immateriil tidak dijadikan pertimbangan eksplisit dalam penjatuhan sanksi restitusi dalam putusan tersebut. Penelitian ini mengharapkan agar LPSK dalam memberikan perlindungan hukum terhadap anak korban dilakukan secara proaktif demi hak-hak korban terpenuhi secara optimal. Serta Hakim dalam menjatuhkan restitusi pada putusannya memperhatikan kerugian immateriil anak korban sebagai bentuk pemulihan menyeluruh bagi anak korban. Complied By: WIDYAYANTI AGUSTIN E1A020036 ABSTRACT The criminal offense of sexual intercourse with a child constitutes a serious crime that has profound physical and psychological impacts on the victim. The state, through the Witness and Victim Protection Agency (LPSK), holds the authority to provide legal protection in order to ensure the fulfillment of the rights of victims. The purpose of this thesis is to examine the legal protection provided by LPSK to child victims in Decision Number 101/Pid.Sus/2023/PN Bek and to analyze the judge’s considerations in imposing restitution sanctions. This research employs a normative juridical method, utilizing secondary data sources such as laws and legal literature. The data obtained is processed and analyzed using a qualitative normative method with a descriptive-analytical research specification. The research findings indicate that the legal protection provided by LPSK in this case was limited to the restitution service, while other rights of the victim have not been fully fulfilled. In the judicial considerations of Decision Number 101/Pid.Sus/2023/PN Bek, the immaterial losses suffered by the child victim were not explicitly considered in the imposition of restitution sanctions. This research recommends that LPSK adopt a more proactive approach in providing legal protection to child victims to ensure the optimal fulfillment of their rights. It also urges judges to take into account immaterial damages in restitution decisions as part of a comprehensive recovery for the child victim.
