| Abstrak (Bhs. Indonesia) | Hukum pidana mengenal beberapa jenis saksi yang membantu jalannya proses persidangan. Saksi dalam tindak pidana adalah seseorang yang akan memberikan keterangan guna kepentingan penyidikan, penuntutan, dan peradilan. Salah satu dari beberapa jenis saksi adalah justice collabolator. Justice collabolator adalah saksi yang berperan sebagai pelaku akan tetapi bersedia bekerja sama dengan aparat penegak hukum untuk mengungkap tindak pidana yang terorganisir. Justice collabolator ini tentu memiliki peran dan dampak dalam sistem peradilan pidana. Penelitian ini bertujuan untuk mengetahui peran dari justice collabolator dalam sistem peradilan pidana sehingga akan berdampak dalam penjatuhan pidana terdakwa. Metode pendekatan yang digunakan dalam penelitian yaitu yuridis normatif dengan spesifikasi penelitian deskriptif analitis dan preskriptif. Sumber data yang digunakan dalam penelitian adalah data sekunder dengan metode pengumpulan data yaitu studi kepustakaan yang kemudian diolah dan dianalisis menggunakan metode deskriptif kualitatif dalam bentuk teks naratif. Berdasarkan hasil penelitian dan pembahasan menunjukkan bahwa peran justice collabolator dalam sistem peradilan pidana berdasarkan putusan nomor 48/Pid.Sus-Tpk/2020/PN.Jkt.Pst dan Putusan Nomor 798/Pid.B/2022/PN.Jkt.Sel adalah untuk mempermudah aparat penegak hukum dalam mengungkap suatu tindak pidana yang terorganisir. Dampak dari peran justice collabolator ini salah satunya adalah berdampak pada perlindungan hak-hak berupa pemberian keringanan pidana yang diberikan kepada Richard Eliezer sebagai justice collabolator berdasarkan Putusan Nomor 798/Pid.B/2022/PN.Jkt.Sel akan tetapi Tommy Sumardi juga sebagai justice collabolator berdasarkan Putusan Nomor 48/Pid.Sus-Tpk/2020/PN.Jkt.Pst tidak ada pemberian keringanan pidana. |

| Abtrak (Bhs. Inggris) | Criminal law recognizes several types of witnesses that help the trial process. A witness in a criminal case is someone who will provide information for the purpose of investigation, prosecution, and trial. One of the several types of witnesses is the justice collabolator. Justice collabolator is a witness who acts as a perpetrator but is willing to cooperate with law enforcement officials to uncover organized crime. Justice collabolator certainly has a role and impact in the criminal justice system. This research aims to find out the role of justice collabolator in the criminal justice system so that it will have an impact on the criminal sentence of the defendant. The approach method used in the research is normative juridical with descriptive analytical and prescriptive research specifications. The data source used in the research is secondary data with data collection method, namely literature study which is then processed and analyzed using qualitative descriptive method in the form of narrative text. Based on the results of research and discussion, it shows that the role of justice collabolator in the criminal justice system based on Decision Number 48/Pid.Sus-Tpk/2020/PN.Jkt.Pst and Decision Number 798/Pid.B/2022/PN.Jkt.Sel is to facilitate law enforcement officials in uncovering an organized crime. One of the impacts of the role of justice collabolator is the impact on the protection of rights in the form of granting criminal leniency given to Richard Eliezer as a justice collabolator based on Decision Number 798/Pid.B/2022/PN.Jkt.Sel but Tommy Sumardi also as a justice collabolator based on Decision Number 48/Pid.Sus-Tpk/2020/PN.Jkt.Pst there is no granting of criminal leniency. |
