| Judul Artikel | ANALISIS YURIDIS PERATURAN PRESIDEN NOMOR 75 TAHUN 2024 TENTANG PERCEPATAN PEMBANGUNAN IBU KOTA NUSANTARA |
| Abstrak (Bhs. Indonesia) | Pemerintahan Presiden Joko Widodo mengadakan program pembangunan ibu kota baru yakni pembangunan Ibu Kota Nusantara (IKN). Demi mempercepat pembangunan IKN serta menarik investor-investor swasta diundangkanlah Peraturan Presiden Nomor 75 Tahun 2024 Tentang Percepatan Pembangunan Ibu Kota Nusantara sebagai turunan dari UU IKN. Salah satu pasal dalam Perpres menimbulkan perdebatan yakni Pasal 9 ayat (2) yang mengatur jangka waktu hak atas tanah yang dinilai melebihi batas dan berpotensi menimbulkan permasalahan hukum. Tujuan dari penelitian ini untuk mengetahui sinkronisasi peraturan perundang-undangan serta potensi permasalahan hukum terhadap hak atas tanah di kawasan IKN yang meliputi HGU, HGB, dan Hak Pakai. Metode pendekatan yang digunakan dalam penelitian ini yakni metode yuridis normatif dengan pendekatan perundang-undangan (statue approach). Spesifikasi penelitian yang digunakan bersifat deskriptif analisis dari studi kepustakaan. Sumber bahan hukum yang telah diperoleh akan disajikan dalam bentuk teks naratif. Penelitian ini mendapatkan hasil bahwa Perpres No. 75 Tahun 2024 mengalami ketidaksinkronan dengan peraturan sebelumnya yang mengatur mengenai pertanahan serta mengabaikan prinsip-prinsip agraria berupa asas kepastian hukum, asas perencanaan umum, dan asas pengakuan hak ulayat. Perpres ini dapat dikatakan sebagai lex specialis dari UUPA karena hanya berlaku di IKN. Tanah negara, tanah masyarakat adat, dan isu pembangunan berkelanjutan dapat menjadi potensi permasalahan hukum akibat diundangkannya Perpres ini. Maka, dibutuhkan evaluasi pada Peraturan Presiden Nomor 75 Tahun 2024 serta pendekatan yang humanis kepada masyarakat. Kata kunci: Hak Atas Tanah, Ibu Kota Nusantara (IKN), Sinkronisasi |
| Abtrak (Bhs. Inggris) | President Joko Widodo's administration held a new capital city development program, namely the construction is Ibu Kota Nusantara (IKN). In order to accelerate the development of IKN and attract private investors, Presidential Regulation Number 75 of 2024 concerning the Acceleration of the Development of the Capital City of the Archipelago was promulgated as a derivative of the IKN Law. One of the articles in the Perpres has caused debate, namely Article 9 paragraph (2) which regulates the period of land rights which is considered to exceed the limit and has the potential to cause legal problems. The purpose of this study is to determine the synchronization of laws and regulations and potential legal problems with land rights in the IKN area which include HGU, HGB, and Hak Pakai. The approach method used in this research is the normative juridical method with a statutory approach (statue approach). The research specifications used are descriptive analysis of literature studies. Sources of legal materials that have been obtained will be presented in the form of narrative text. This research found that Presidential Regulation No. 75 of 2024 is unsynchronized with previous regulations governing land and ignores agrarian principles in the form of the principle of legal certainty, the principle of general planning, and the principle of recognition of customary rights. This regulation can be said to be a lex specialis of UUPA because it only applies to IKN. State land, indigenous peoples' land, and sustainable development issues may become potential legal problems due to the promulgation of this Perpres. Therefore, an evaluation of Presidential Regulation Number 75 Year 2024 and a humanist approach to the community are needed.
