Indonesia) | Penyalahgunaan narkotika meningkat setiap tahunnya, khusus wilayah Kabupaten Cilacap data ungkap kasus menunjukan peningkatan jumlah kasus dari 87 kasus pada tahun 2022 menjadi 102 kasus pada tahun 2023. Penyalahgunaan narkotika menimbulkan dampak negatif pada fisik maupun psikisnya bahkan dapat menimbulkan multiple effect yang berkaitan dengan beragam perbuatan kriminal lainnya. Permasalahan pokok dalam penelitian ini adalah bagaimana peran BNNK Cilacap dalam penegakan hukum terhadap tindak pidana narkotika menurut UU No. 35 Tahun 2009 dan faktor penghambat BNNK Cilacap dalam penegakan hukum terhadap tindak pidana narkotika. Penelitian ini mengunakan metode penelitian yuridis sosiologis dan dianalisis dengan metode kualitatif. Hasil analisis menunjukan bahwa upaya BNNK Cilacap dalam penegakan hukum terhaadap tindak pidana narkotika menurut UU No. 35 Tahun 2009 dilakukan dengan upaya pencegahan dan pemberdayaan masyarakat, rehabilitasi dan pemberantasan. Dalam menjalankan perannya sebagai penegak hukum, BNNK Cilacap menghadapi sejumlah hambatan. Beberapa aspek terkait narkotika belum sepenuhnya tercakup dalam UU No. 30 Tahun 2009 tentang narkotika. Selain itu, jumlah personil BNNK Cilacap yang terbatas tidak sebanding dengan luas wilayah Cilacap. Keterbatasan anggaran berpengaruh pada pelaksanaan tugas pencegahan dan pemberantasan, sehingga kurang optimal. Disisi lain partisipasi masyarakat yang masih rendah, dan cenderung acuh tak acuh terhadap pelanggaran hukum. |
| Abtrak (Bhs. Inggris) | Narcotics abuse increases every year, especially for Cilacap Regency, data on cases shows an increase in the number of cases from 87 cases in 2022 to 102 cases in 2023. Narcotics abuse has a negative impact on the physical and psychological, and can even cause multiple effects related to various other criminal acts. The main problem in this research is the role of the Cilacap BNNK in law enforcement against narcotics crimes according to Law no. 35 of 2009 and inhibiting factors for BNNK Cilacap in enforcing the law against narcotics crimes. This research uses sociological juridical research methods and is analyzed using qualitative methods. The results of the analysis show that Cilacap BNNK's efforts in enforcing the law against narcotics crimes according to Law no. 35 of 2009 is carried out with efforts to prevent and empower the community, rehabilitation and eradication. In carrying out its role as law enforcer, BNNK Cilacap faces a number of obstacles. Several aspects related to narcotics are not yet fully covered in Law no. 30 of 2009 concerning narcotics. Apart from that, the limited number of Cilacap BNNK personnel is not comparable to the area of Cilacap Regency. Budget limitations also have an impact, resulting in less than optimal implementation of prevention and eradication tasks. On the other hand, public participation is still low, and there is a tendency for society to be indifferent to law violations that occur. |
