| Abstrak (Bhs. Indonesia) | Merek merupakan sebuah tanda yang memiliki daya pembeda dan digunakan dalam perdagangan barang dan/atau jasa. Merek dilindungi berdasarkan prinsip first to file yaitu pendaftar pertama yang mengajukan permohonan pendaftaran berhak mendapatkan perlindungan hak atas mereknya. Perlindungan hukum terhadap merek terdaftar tidak menjadi jaminan karena masih banyak pihak-pihak yang beritikad tidak baik untuk mendaftarkan mereknya dengan cara meniru merek orang lain. Tujuan penelitian adalah untuk mengetahui bagaimana perlindungan hukum bagi pemegang merek “SIMAY” serta akibat hukum pembatalan suatu merek terdaftar berdasarkan Undang-Undang Nomor 20 Tahun 2016 dalam Putusan Pengadilan Niaga Jakarta Pusat Nomor 54/Pdt.SUS-Merek/2023/PN.Niaga.Jkt.Pst. Metode pendekatan yang digunakan pada penelitian yaitu yuridis normatif dengan spesifikasi penelitian deskriptif analisis. Sumber data yang digunakan adalah data sekunder dan metode pengumpulan data dilakukan dengan studi kepustakaan, data yang diperoleh diolah dalam bentuk teks naratif dengan metode analisis data yang digunakan yaitu normatif kualitatif. Berdasarkan hasil penelitian dan pembahasan menunjukkan bahwa dikabulkannya gugatan pembatalan merek “NIMAY” milik tergugat merupakan upaya perlindungan hukum terhadap merek terdaftar “SIMAY” milik penggugat sesuai dengan ketentuan yang diatur dalam Pasal 21 ayat (1) huruf a Undang-Undang Nomor 20 Tahun 2016 Tentang Merek dan Indikasi Geografis. Akibat hukum bagi Merek “NIMAY” adalah pencoretan merek tersebut dari Daftar Umum Merek yang diumumkan dalam Berita Resmi oleh Direktorat Jenderal Kekayaan Intelektual, karena merek “NIMAY” memiliki persamaan pada pokoknya atau keseluruhan dengan merek “SIMAY” milik penggugat. |
| Abtrak (Bhs. Inggris) | Trademark is a sign that has a distinguishing power and is used in the trade of goods and / or services. Trademark is protected based on the principle of first to file that is the first registrant who filed an application for registration is entitled to get the protection of rights to the trademark. Legal protection of registered trademarks is not a guarantee because there are still many parties who have bad faith to register their trademarks by imitating other people's trademarks. The purpose of the research is to find out how the legal protection for “SIMAY” trademark holders as well as the legal consequences of canceling a registered trademark based on Law Number 20 Year 2016 in the Central Jakarta Commercial Court Decision Number 54/Pdt.SUS-Merek/2023/PN.Niaga.Jkt.Pst. The approach method used in the research is normative juridical with descriptive analysis research specifications. The data source used is secondary data and the data collection method is carried out by literature study, then the data obtained is processed in the form of narrative text with the data analysis method used, namely normative qualitative. Based on the results of research and discussion, it shows that the granting of the lawsuit for the cancellation of the defendant's “NIMAY” trademark is an effort to protect the law against the registered trademark “SIMAY” owned by the plaintiff in accordance with the provisions stipulated in Article 21 paragraph (1) letter a of Law Number 20 Year 2016 concerning Trademarks and Geographical Indications. The legal consequence for the “NIMAY” trademark is the removal of the trademark from the General Register of Trademarks announced in the Official Gazette by the Directorate General of Intellectual Property, because the “NIMAY” trademark is substantially or wholly similar to the “SIMAY” trademark owned by the plaintiff. |
