| Abstrak (Bhs. Indonesia) | Permasalahan desain industri di Indonesia sering muncul dari tidak adanya kesadaran pihak-pihak yang melanggar atas hasil karya orang lain yang telah menciptakan ciptaan tersebut dengan berkorban banyak hal, mulai dari tenaga, pikiran, waktu, bahkan dana untuk menghasilkan ciptaannya. Penelitian ini menganalisis tentang bagaimana perlindungan hukum dan akibat hukum terhadap putusan 78/Pdt.Sus-HKI/Desain Industri/2022/PN Niaga Jkt.Pst. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, pendekatan kasus, dan pendekatan konseptual. Hasil penelitian menunjukan bahwa Tergugat dalam kasus ini bersalah karena telah melakukan Perbuatan Melanggar Hukum atas produk genset koper yang memiliki kemiripan/sama persis dengan genset inverter milik Penggugat, dimana Tergugat mendaftarkan produknya dengan itikad tidak baik saat mengetahui bahwa produk miliknya memiliki kemiripan/sama persis dengan produk milik Penggugat. Tergugat mengajukan permohonan pendaftaran produknya tertanggal 14 Desember 2020, jauh setelah Penggugat telah memperjualbelikan produk miliknya. Penggugat sebagai pendaftar yang terlebih dahulu berhak mendapatkan perlindungan atas haknya. Mengetahui hal ini Penggugat mengajukan gugatan kepada Tergugat untuk menghapuskan pendaftaran produk milik Tergugat. Pembatalan pendaftaran produk milik Tergugat mengakibatkan dihapuskannya hak dan perlindungan hukum yang dimiliki Tergugat terhadap produk desain industri miliknya. Tergugat juga dibebankan untuk membayar biaya perkara sejumlah Rp. 1.240.000. Dengan ini diharapkan pihak-pihak yang akan mendaftarkan produk desain industri untuk dapat lebih memahami peraturan tentang desain industri agar tidak terjadi suatu perbuatan melawan hukum yang dapat menimbulkan sengketa. |

Inggris) | Industrial design issues in Indonesia often arise from the lack of awareness of the parties who infringe on the work of other people who have created these creations by sacrificing many things, starting from energy, thoughts, time, and even funds to produce their creations. This research analyzes the legal protection and legal consequences of decision 78/Pdt.Sus-HKI/Desain Industri/2022/PN Niaga Jkt.Pst. This research uses a normative juridical method with a legislative approach, a case approach and a conceptual approach. The research results show that the Defendant in this case is guilty of committing an unlawful act regarding a suitcase generator product which is similar/exactly the same as the Plaintiff's inverter generator, where the Defendant registered his product in bad faith when he knew that his product was similar/exactly the same as Plaintiff's product. The Defendant submitted an application for registration of his product on December 14th, 2020, long after the Plaintiff had been selling his product. The plaintiff as the first registrant is entitled to protection of his rights. Knowing this, the Plaintiff filed a lawsuit against the Defendant to cancel the registration of the Defendant's product. The cancellation of the registration of the Defendant's product resulted in the elimination of the legal rights and protection that the Defendant had for his industrial design product. The defendant is also charged with paying court costs in the amount of Rp. 1,240,000. With this, it is hoped that parties who will register industrial design products will be able to better understand the regulations regarding industrial design so that there are no unlawful acts that could give rise to disputes. |
