| Abstrak (Bhs. Indonesia) | Terhadap putusan hakim yang oleh para pihak merasa putusan hakim kurang memenuhi rasa keadilan dapat diajukan upaya hukum baik banding maupun kasasi. Khusus putusan bebas tidak dapat dilakukan upaya hukum, tetapi berdasarkan Putusan Mahkamah Konstitusi Nomor 114/PUU-X/2012 yang menyatakan frasa putusan bebas dalam Pasal 244 KUHAP tidak memiliki kekuatan hukum mengikat sehingga Mahkamah Agung berwenang memeriksa permohonan kasasi terhadap putusan bebas. Terhadap putusan bebas Mahkamah Agung memeriksa apabila terjadi kesalahan penerapan hukum sebagaimana pada putusan Pengadilan Negeri Banda Aceh Nomor 9/Pid.Sus-TPK/2020/PN Bna yang memutus bebas terdakwa tindak pidana korupsi. Penelitian ini akan berfokus kepada pertimbangan hakim di tingkat kasasi dalam membatalkan putusan pengadilan tingkat pertama serta akibat hukum yang ditimbulkan. Metode penelitian yang digunakan yaitu yuridis normatif dengan spesifikasi penelitian preskriptif menggunakan data penelitian sekunder berupa berupa bahan hukum primer yaitu Putusan Mahkamah Agung Nomor 2686 K/Pid.Sus/2021 dengan pengumpulan data studi kepustakaan yang kemudian disajikan melalui teks naratif yang dianalisis dengan metode normatif kualitatif. Hasil penelitian ini Mahkamah Agung sebagai judex juris menilai alasan kasasi yang diajukan dapat dibenarkan karena dibebaskannya terdakwa dari dakwaan penuntut umum adalah salah penerapan hukum dengan tidak mempertimbangkan fakta hukum baik keterangan saksi, surat maupun keterangan terdakwa sehingga membatalkan putusan bebas. Dengan batalnya putusan bebas tersebut maka menimbulkan akibat hukum yaitu membatalkan Putusan Pengadilan Negeri Aceh Nomor 9/Pid.Sus-TPK/2020/PN Bna sehingga status terdakwa dari bebas menjadi dijatuhi hukuman pidana. | Abtrak (Bhs. Inggris) | Against a judge's decision that the parties feel the judge's decision does not fulfil a sense of justice, legal remedies can be filed either appeal or cassation. Specifically for acquittal verdicts, no legal remedy can be taken, but based on the Constitutional Court Decision Number 114/PUU-X/2012 which states that the phrase acquittal in Article 244 of the Criminal Procedure Code does not have binding legal force so that the Supreme Court has the authority to examine cassation applications against acquittal verdicts. The Supreme Court examines acquittals when there is an error in the application of the law as in the decision of the Banda Aceh District Court Number 9/Pid.Sus-TPK/2020/PN Bna which acquitted the defendant of a corruption crime. This research will focus on the considerations of judges at the cassation level in cancelling first instance court decisions and the resulting legal consequences. The research method used is normative juridical with prescriptive research specifications using secondary research data in the form of primary legal material, namely Supreme Court Decision Number 2686 K/Pid.Sus/2021 with literature study data collection which is then presented through narrative text which is analysed using qualitative normative methods. The result of this research is that the Supreme Court as judex juris considers that the reasons for the cassation submitted can be justified because the acquittal of the defendant from the public prosecutor's charges was a misapplication of the law by not considering the legal facts, both witness testimony, letters and the defendant's testimony.
