| Abstrak (Bhs. Indonesia) | Indonesia sebagai negara hukum yang menganut sistem desentralisasi dalam melahirkan konsep otonomi daerah dalam tatanan pemerintahannya. Salah satu aspek pelaksanaan otonomi daerah adalah dalam hal perizinan. Pelayanan perizinan di tingkat Kabupaten atau Kota kewenangannya dapat dilimpahkan kepada Camat. Mengacu pada ketentuan Undang – Undang Nomor 32 Tahun 2004 tentang Pemerintahan Daerah, Peraturan Pemerintah Nomor 19 Tahun 2008 tentang Kecamatan dan Peraturan Daerah Kabupaten Banyumas Nomor 13 Tahun 2008 tentang Organisasi Tata Kerja Kecamatan Dan Kelurahan Di Kabupaten Banyumas bahwa Camat dalam pelaksanaan tugasnya memperoleh pelimpahan sebagian wewenang pemerintahan oleh Bupati untuk menangani urusan otonomi daerah yang salah satunya meliputi aspek perizinan. Pelaksanaan ketentuan tersebut ditetapkan dengan Peraturan Bupati Banyumas Nomor 9 Tahun 2010 tentang Pelimpahan Kewenangan Perizinan Kepada Camat Di Kabupaten Banyumas. Akibat hukum yang timbul dari masalah perizinan yang kewenangannya telah dilimpahkan kepada Camat, tanggung jawab dan tanggung gugatnya beralih dari Bupati Banyumas kepada Camat. Upaya penyelesaian sengketa akibat dikeluarkannya izin oleh Camat tersebut adalah melalui upaya administratif yakni dengan mengajukan keberatan kepada Camat dan banding administratif kepada Bupati Banyumas. |
