| Abstrak (Bhs. Indonesia) | PEMILIHAN PRESIDEN DAN WAKIL PRESIDEN DALAM SATU PAKET UUD 1945 menegaskan bahwa presiden dipilih secara langsung oleh rakyat. Berdasarkan hal tersebut, maka penelitian ini mengkaji tentang pemilihan umum Presiden secara langsung berdasarkan UUD 1945 setelah amandemen. Adapun metode pendekatan yang digunakan dalam penelitian ini adalah pendekatan perundang-undangan (Statute Approach), dengan spesifikasi penelitian deskriptif, bahan hukum primer dan sekunder sebagai sumber bahan hukum, yang diperoleh dengan cara inventarisasi terhadap peraturan perundang-undangan dan buku kepustakaan yang ada relevansinya dengan obyek penelitian, dan dianalisis secara normatif kualitatif. Berdasarkan hasil penelitian dan pembahasan, diperoleh kesimpulan sebagai berikut: 1. Pemilihan umum Presiden dan Wakil Presiden berdasarkan Undang-Undang Dasar 1945 setelah amandemen diatur dalam Pasal 6A dan sebagai peraturan pelaksanaannya diatur dalam Undang-undang Nomor 42 Tahun 2008 tentang Pemilihan Umum Presiden dan Wakil Presiden. 2. Pemilihan umum Presiden dilakukan secara langsung dan dalam satu paket dengan pemilihan Wakil Presiden. Pengajuan calon Presiden dan Wakil Presiden yang diselenggarakan secara langsung dibatasi hanya dari partai politik atau gabungan partai politik. Terhadap pengajuan pasangan calon Presiden dan Wakil Presiden ditetapkan adanya syarat persentase ambang batas pengajuan pasangan calon Presiden dan Wakil Presiden, yaitu 20% dari perolehan jumlah kursi di DPR dan 25% perolehan suara sah nasional partai politik dalam pemilu legislatif. 3. Mekanisme pemilihan presiden dan wakil presiden dilakukan melalui sistem mayoritas absolut (absolute majority) dan mayoritas sederhana (simple majority). Prinsip mayoritas absolut diterapkan apabila telah diperoleh pasangan calon yang memperoleh suara lebih dari 50% yang kemudian akan dilantik menjadi presiden dan wakil presiden. Sedangkan apabila tidak terpenuhi suara lebih dari 50% maka diterapkan mayoritas sederhana (simple majority) melalui putaran kedua atau dikenal juga dengan istilah “first past the post election” |
| Abtrak (Bhs. Inggris) | SELECTION OF PRESIDENT AND VICE PRESIDENT IN ONE PACKAGE UUD 1945 states that the chosed president is elected directly by the people. Based on that, so this research examines about the election of President directly based on the UUD 1945 after the amendment. And the method of approach that is used in this research is the Statute Approach, with the specification of descriptive research, material of primary and secondary law as the source of law material, that is obtained with the inventory to the ordinance regulation and literature books that has the relevance with the research object, and then and analyzed as normative qualitative Based on the research result and discussion, it is obtained the conclusion as following: 1. The election of President and Vice President based on the UUD 1945 after amendment it is regulated in the article 6A and as the its Implementation regulation is regulated in the Law Number 42, 2008 about the Election of President and Vice President. 2. The election of President is conducted directly and in one packet with the election of Vice President. The candidate proposal of President and Vice President that conducted directly is delimitated just from the politic party or integration party.To the candidate proposal of President and Vice President are stated with the percentage requirement of maximum and minimum of President and Vice President candidate that is 20% from the number of chairs in DPR and 25% the obtaining of national legal voice of politic party in the legislative election. 3. The mechanism of president and vice president election is conducted through the absolute majority and simple majority. The principle of absolute majority is stated if it has obtained the candidate that obtained the voice more than 50% that hen it sill be stated as the president and voice president. And if there is no fulfillment the voice more than 50% so it will implement the simple majority through the second election or known with the terminology as “first past the post election”. |
