| Abstrak (Bhs. Indonesia) | Penanganan perkara tindak pidana secara umum diselesaikan di Pengadilan dengan hasil akhir yaitu berupa putusan hakim yang menghukum terpidana. Hukumanya sendiri diberikan berorientasi pada pemberian hukuman kepada pelaku. Dalam proses penanganan perkara tindak pidana anak dalam hal ini memiliki perbedaan dalam proses penyelesaian perkara tindak pidana yang terjadi. Aparat penegak hukum dalam hal ini adalah kepolisian telah menerapkan penyelesaian perkara tindak pidana yang dilakukan oleh anak dengan pendekatan restorative justice untuk perkara yang relative ringan. Melihat hal tersebut, Kepolisian Polres Bantul turut melaksanakan dengan salah satu perkaranya yaitu dugaan tindak pidana kejahatan jalanan klitih yang dilakukan oleh anak dibawah umur. Tujuan penelitian ini yaitu untuk mengetahui pertimbangan penyidik Kepolisian Polres Bantul dalam menyatakan berhasil atau tidaknya pendekatan restorative justice dalam perkara tersebut dan untuk mengetahui sesuai atau tidaknya pendekatan restorative justice dalam perkara tersebut dengan Peraturan Kepolisian Negara Republik Indonesia Nomor 8 Tahun 2021. Metode Pendekatan pada penelitian ini yaitu yuridis sosiologis dengan spesifikasi penelitian deskriptif analitis, sedangkan metode pengumpulan datanya melalui wawancara dan studi pustaka yang kemudian dianalisis kualitatif. Hasil dari penelitian ini yaitu pendekatan restorative justice dalam dugaan tindak pidana kejahatan jalanan klitih telah berhasil dengan pertimbangan tindak pidana yang dilakukan termasuk jenis tindak pidana ringan dan pemberian kerugian telah dilakukan oleh pelaku. Dalam pelaksanaanya, hal tersebut telah sesuai dengan Peraturan Kepolisian Negara Republik Indonesia Nomor 8 Tahun 2021. |
| Abtrak (Bhs. Inggris) | Handling of criminal cases is generally resolved in court with the final result being a judge's decision that convicts the convict. The punishment itself is oriented towards giving punishment to the perpetrator. In the process of handling juvenile criminal cases, in this case there are differences in the process of resolving criminal cases that occur. Law enforcement officials, in this case the police, have implemented the resolution of criminal cases committed by children using a restorative justice approach for relatively minor cases. Seeing this, the Bantul Police took part in carrying out one of the cases, namely the alleged criminal act of Klitih street crime committed by a minor. The purpose of this research is to find out the considerations of Bantul Police investigators in declaring whether or not the restorative justice approach was successful in this case and to find out whether or not the restorative justice approach in this case is in accordance with the Republic of Indonesia State Police Regulation Number 8 of 2021. Approach Method in this research namely sociological juridical with analytical descriptive research specifications, while the data collection method is through interviews and literature studies which are then analyzed qualitatively. The results of this research are that the restorative justice approach in suspected Klitih street crimes has been successful considering that the criminal acts committed are minor crimes and the damages have been committed by the perpetrator. In its implementation, this is in accordance with the Republic of Indonesia State Police Regulation Number 8 of 2021. |
