| Abstrak (Bhs. Indonesia) | Merek merupakan salah satu bentuk hak kekayaan intelektual yang berperan penting dalam dunia perdagangan terlebih di era globalisasi. Merek sebagai identitas yang membedakan produk barang dan/atau jasa sejenis, sehingga konsumen dapat membedakan asal, kualitas, dan keaslian suatu produk. Merek terkenal harus mendapatkan perlindungan hukum dari negara agar terhindar dari pelanggaran merek yang dapat merugikan para pihak. Pendaftaran merek bertujuan untuk memberikan perlindungan hukum terhadap suatu merek. Pendaftaran merek di Indonesia menganut sistem konstitutif (first to file) bahwa yang berhak atas hak merek tersebut adalah orang yang pertama kali mendaftarkan mereknya. Penelitian ini bertujuan untuk mengetahui bagaimana perlindungan hukum terhadap merek “F FUEL” dan akibat hukum terhadap pembatalan merek “F FUEL” ditinjau dari Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis dalam Putusan Nomor 1/Pdt.Sus-HKI/Merek/2023/ PN Niaga Jkt. Pst. Metode pendekatan yang digunakan dalam penelitian ini adalah metode yuridis normatif dengan spesifikasi penelitian deskriptif analitis. Sumber data yang digunakan adalah data sekunder yang dikumpulkan dengan studi kepustakaan, kemudian dianalisis menggunakan metode normatif kualitatif dan disajikan dalam bentuk teks naratif. Berdasarkan hasil penelitian dan pembahasan menunjukkan bahwa Majelis Hakim telah memberikan perlindungan hukum terhadap merek “F FUEL” milik Penggugat dengan mengabulkan gugatan pembatalan Putusan Komisi Banding Merek Nomor 569/KBM/HKI/2022, karena merek Penggugat tidak memenuhi unsur ketentuan Pasal 21 ayat (1) huruf a Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis serta Penggugat mendaftarkan mereknya dengan iktikad baik. Akibat hukum dari perbuatan Tergugat yakni dengan diterbitkannya Sertifikat Pendaftaran Merek Dagang “F FUEL” atas nama Penggugat serta mencatat pendaftarannya dalam Daftar Umum Direktorat Merek dan Indikasi Geografis. |
| Abtrak (Bhs. Inggris) | Brands are a form of intellectual property rights that play an important role in the world of trade, especially in the era of globalization. A brand is an identity that differentiates similar goods and/or services, so that consumers can differentiate the origin, quality and authenticity of a product. Well-known brands must receive legal protection from the state to avoid trademark infringement which could harm the parties. Trademark registration aims to provide legal protection for a brand. Trademark registration in Indonesia follows a constitutive system (first to file) where the person entitled to the trademark rights is the person who first registered the trademark. This research aims to find out how the legal protection of the "F FUEL" brand is and the legal consequences of canceling the "F FUEL" brand in terms of Law Number 20 of 2016 concerning Marks and Geographical Indications in Decision Number 1/Pdt.Sus-HKI/Brand /2023/ PN Niaga Jkt. Pst. The approach method used in this research is a normative juridical method with analytical descriptive research specifications. The data source used is secondary data collected through literature study, then analyzed using qualitative normative methods and presented in the form of narrative text. Based on the results of the research and discussion, it shows that the Panel of Judges has provided legal protection to the Plaintiff's "F FUEL" brand by granting the lawsuit to annul the Mark Appeal Commission Decision Number 569/KBM/HKI/2022, because the Plaintiff's mark does not meet the elements of Article 21 paragraph (1) letter a of Law Number 20 of 2016 concerning Marks and Geographical Indications and the Plaintiff registered his mark in good faith. The legal consequence of the Defendant's actions is the issuance of a Registration Certificate for the Trademark "F FUEL" in the name of the Plaintiff and recording its registration in the General Register of the Directorate of Trademarks and Geographical Indications. |
