| Abstrak (Bhs. Indonesia) | Beredarnya rokok ilegal tanpa label informasi dan peringatan kesehatan di masyarakat menjadikan masyarakat kekurangan informasi mengenai bahaya merokok sehingga dapat merugikan maupun menyesatkan masyarakat selaku konsumen yang mengkonsumsi produk rokok tersebut. Penelitian ini bertujuan mengetahui perlindungan hukum terhadap konsumen rokok ilegal tanpa label informasi dan peringatan kesehatan pada kemasan dalam Putusan Pengadilan Negeri Padang Nomor : 424/Pid.sus/2023/PN Pdg berdasarkan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Penelitian ini menggunakan metode yuridis normatif dengan spesifikasi penelitian deskriptif analitis. Sumber data yang digunakan adalah sumber data sekunder yang mencakup bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier yang dilakukan dengan studi kepustakaan. Data yang diperoleh kemudian disajikan dalam bentuk teks naratif yang tersusun sistematis, logis, dan rasional yang dianalisis secara normatif kualitatif. Berdasarkan hasil penelitian yang dilakukan, diperoleh hasil bahwa konsumen telah mendapatkan perlindungan hukum yang sesuai dengan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen melalui putusan hakim yang menjatuhkan pidana penjara selama 1 (satu) tahun 7 (tujuh) bulan dengan memperhatikan Pasal 62 ayat (1) Jo. Pasal 8 ayat (1) huruf i Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Perbuatan pelaku usaha tersebut selain telah memenuhi Pasal 8 ayat (1) huruf i Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen juga telah melanggar hak konsumen khususnya hak yang tercantum pada pasal 4 huruf a dan c Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen yaitu hak atas kenyamanan, keamanan dan keselamatan dalam mengkonsumsi barang dan/atau jasa serta hak atas informasi yang benar, jelas dan jujur mengenai kondisi dan jaminan barang dan/atau jasa. |

Inggris) | The circulation of illegal cigarettes without information labels and health warnings in the community means that the public lacks information about the dangers of smoking so that it can harm or mislead the public as consumers who consume these cigarette products. This research aims to determine the legal protection for consumers of illegal cigarettes without information labels and health warnings on the packaging in the Padang District Court Decision Number : 424/Pid.sus/2023/PN Pdg based on Law Number 8 of 1999 concerning Consumer Protection. This research uses normative juridical methods with analytical descriptive research specifications. The data sources used are secondary data sources which include primary legal materials, secondary legal materials and tertiary legal materials which are carried out using library research. The data obtained is then presented in the form of narrative text which is arranged systematically, logically and rationally which is analyzed normatively qualitatively. Based on the results of the research carried out, it was found that consumers had received legal protection in accordance with Law Number 8 of 1999 concerning Consumer Protection through a judge's decision which sentenced them to imprisonment for 1 (one) year 7 (seven) months by taking into account Article 62 paragraph (1) Jo. Article 8 paragraph (1) letter i Law Number 8 of 1999 concerning Consumer Protection. The actions of these business actors, apart from complying with Article 8 paragraph (1) letter i of Law Number 8 of 1999 concerning Consumer Protection, have also violated consumer rights, especially the rights stated in Article 4 letters a and c of Law Number 8 of 1999 concerning Consumer Protection, namely the rights for comfort, security and safety in consuming goods and/or services as well as the right to correct, clear and honest information regarding the condition and guarantee of goods and/or services. |
