| Abstrak (Bhs. Indonesia) | Pendaftaran merek di Indonesia menganut prinsip first to file yaitu pendaftar pertama yang mengajukan permohonan pendaftaran merek berhak mendapatkan perlindungan hak atas mereknya. Persaingan usaha yang semakin meningkat menyebabkan terjadinya kecurangan dengan meniru merek orang lain, terurtama merek terkenal atas dasar iktikad tidak baik mendaftarkan mereknya. Tujuan penelitian ini untuk mengetahui bagaimana perlindungan hukum terhadap merek terkenal “JOYKO” serta akibat hukum terhadap merek yang memiliki persamaan pada pokoknya atau keseluruhan dalam putusan nomor 41/Pdt.Sus-Merek/2023/PN.Niaga.Jkt.Pst ditinjau dari Undang-Undang Nomor 20 Tahun 2016 Tentang Merek dan Indikasi Geografis. Metode yang digunakan dalam penelitian yaitu pendekatan yuridis normatif dengan spesifikasi penelitian deskriptif. Sumber data yang digunakan merupakan data sekunder yang terdiri dari bahan hukum primer dan bahan hukum sekunder yang kemudian dikumpulkan melalui studi kepustakaan, dan diolah serta dianalisis menggunakan metode normatif kualitatif disajikan dalam bentuk teks naratif. Berdasarkan hasil penelitian dan pembahasan dapat disimpulkan bahwa dikabulkannya gugatan pembatalan merek “JOYCO” dan “JOYKO” milik Tergugat sesuai dengan ketentuan yang diatur dalam Pasal 21 ayat (1) huruf a, b dan ayat (3) Undang-Undang Nomor 20 Tahun 2016 Tentang Merek dan Indikasi Geografis sebagai bentuk perlindungan hukum terhadap merek terkenal “JOYKO” milik penggugat. Akibat hukum terhadap merek yang memiliki persamaan pada pokoknya atau keseluruhan dengan merek “JOYKO” milik Penggugat adalah merek tersebut dicoret dari Daftar Umum Merek yang diumumkan dalam Berita Resmi oleh Direktorat Jenderal Kekayaan Intelektual. |

Inggris) | The registration of trademarks in Indonesia adheres to the first-to-file principle, meaning the first applicant to submit a trademark registration application is entitled to protection for their trademark. The increasing business competition has led to fraudulent practices of imitating others' trademarks, especially well-known brands, with the malicious intent of registering those trademarks. The purpose of this research is to determine how legal protection is applied to the famous "JOYKO" brand and the legal consequences for trademarks that are similar in substance or overall in the decision number 41/Pdt.Sus-Merek/2023/PN.Niaga.Jkt.Pst, reviewed by Law Number 20 of 2016 concerning Trademarks and Geographical Indications. This research utilizes a normative juridical approach with a descriptive research specification. The data sources used are secondary data consisting of primary legal materials and secondary legal materials, which are then collected through literature studies, processed, and analyzed using a qualitative normative method presented in the form of narrative text. Based on the research results and discussions, it can be concluded that the approval of the cancellation lawsuit for the "JOYCO" and "JOYKO" trademarks owned by the Defendant is by the provisions stipulated in Article 21 paragraph (1) letters a, b, and paragraph (3) of Law Number 20 of 2016 concerning Trademarks and Geographical Indications as a form of legal protection for the famous "JOYKO" trademark owned by the Plaintiff. The legal consequence for trademarks that are similar in substance or overall to the "JOYKO" trademark owned by the Plaintiff is that the said trademarks are removed from the General Trademark Register announced in the Official Gazette by the Directorate General of Intellectual Property. |
