| Abstrak (Bhs. Indonesia) | Penelitian ini dilatar belakangi oleh permasalahan dalam hal penolakan atau enggannya wali nasab dikarenakan adanya surat wasiat yang berisi perintah untuk menolak menjadi wali nikah apabila Pemohon tetap bersikeras menikah dengan calon suami pilihannya, sebagaimana kasus yang terjadi di daerah Banyuwangi dalam Putusan Nomor 0126/Pdt.P/2022/PA.Bwi. Penelitian ini menggunakan metode penelitian yuridis normatif dengan spesifikasi penelitian deskriptif analitis. Sumber data yang digunakan adalah data sekunder yang diperoleh dari studi kepustakaan. Data yang diperoleh disajikan dalam bentuk teks naratif dengan menggunakan metode analisis normatif kualitatif. Berdasarkan data hasil penelitian dan pembahasan menunjukkan bahwa Majelis Hakim telah mengabulkan permohonan wali adhal karena penolakan wali nasab atas dasar surat wasiat. Hakim mendasarkan pada ketentuan Pasal 23 Instruksi Presiden No 1 Tahun 1991 Tentang Kompilasi Hukum Islam dan Pasal 2 ayat 2 Peraturan Menteri Agama Nomor Nomor 30 Tahun 2005, yang pada intinya menyatakan apabila wali nasab calon mempelai wanita adhal maka pernikahan dilangsungkan oleh wali hakim. Menurut peneliti, alasan penolakan wali nasab atas surat wasiat tidak bersifat syar’i, karena tidak bersifat syar’i maka permohonan wali adhal dikabulkan hakim. Oleh karena itu wali nasabnya digantikan kepada wali hakim, hal ini sesuai dengan ketentuan Pasal 23 Kompilasi Hukum Islam. Akibat hukum yang timbul dari dikabulkannya permohonan wali adhal yaitu berpindahnya wali nikah dari wali nasab kepada wali hakim. Dalam pelaksanaanya perkawinan karena wali adhal, wali hakim tetap akan menawarkan kembali kepada wali nasabnya untuk menikahkan calon mempelai wanita. Apabila wali nasab tetap menolak maka akan dilaksanakan dengan menggunakan wali hakim. Hal ini sesuai dengan ketentuan yang di atur dalam Pasal 5 Peraturan Menteri Agama Nomor 30 tahun 2005 tentang Wali Hakim. |
| Abtrak (Bhs. Inggris) | Guardian in Islamic marriage law is one of the pillars that must be fulfilled in a marriage. The existence of a guardian who refuses or is unwilling to marry his daughter is called a guardian adhal. This research is motivated by problems in the rejection or reluctance of the guardian by reason of a testament due to the existence of a letter of instruction that commands the rejection of becoming the guardian for marriage if the Applicant insists on marrying her chosen husband, such as a case that occurred in the Banyuwangi area in Decision Number 0126 / Pdt.P / 2022 / PA.Bwi. This research uses a normative juridical research method with descriptive analytical research specifications. The data source used is secondary data obtained from literature studies. The data obtained is presented in the form of narrative text using qualitative normative analysis methods. Based on the research data and discussions, it is shown that the Panel of Judges has granted the request for wali adhal due to the rejection of the wali nasab based on the letter of instruction that commands the refusal to act as the marriage guardian if the Applicant insists on marrying her chosen husband. The judge based this decision on the provisions of Article 23 of Presidential Instruction No. 1 of 1991 concerning the Compilation of Islamic Law and Article 2 number 2 of the Minister of Religious Affairs Regulation Number 2 of 1987 which has been amended by Minister of Religious Affairs Regulation Number 30 of 2005, which essentially states that if the guardian of the prospective female bride is adhal, then the marriage is conducted by the judge as the guardian. According to the researcher, the reason for the rejection of the wali nasab based on the letter of instruction is not of a religious nature, and because it is not of a religious nature, the request for wali adhal is granted by the judge. Therefore, the wali nasab is replaced by the judge as the guardian, in accordance with the provisions of Article 23 of the Compilation of Islamic Law. The legal consequence arising from the granting of the request for wali adhal is the transfer of the marriage guardian from the wali nasab to the judge as the guardian and must be in accordance with the decision of the Religious Court according to the provisions of Article 23 of the Compilation of Islamic Law. In the implementation of marriage due to wali adhal, the judge as the guardian will still offer the role back to the wali nasab to marry the prospective female bride. If the wali nasab still refuses, then it will be carried out with the judge as the guardian. This is in accordance with the provisions set forth in Article 5 of the Minister of Religious Affairs Regulation Number 30 of 2005 concerning the Judge as a Guardian. |
