| Abstrak (Bhs. Indonesia) | Pembatalan perkawinan merupakan batalnya suatu perkawinan karena tidak memenuhi syarat perkawinan. Salah satu penyebab terjadinya pembatalan perkawinan adalah karena adanya pemalsuan identitas, seperti dalam perkara mengenai pembatalan perkawinan pada Pengadilan Agama Kabupaten Kediri dengan Nomor Putusan 751/Pdt.G/2023/PA.Kab.Kdr. Pembatalan perkawinan terjadi karena pemalsuan identitas yang dilakukan oleh Termohon I yang mengaku masih jejaka, padahal kenyataannya masih berstatus sebagai suami sah dari perempuan lain. Penelitian ini bertujuan untuk mengetahui dasar pertimbangan hukum hakim dalam mengabulkan perkara permohonan pembatalan perkawinan pada Putusan Nomor 751/Pdt.G/2023/PA.Kab.Kdr. serta untuk mengetahui akibat hukum dari pembatalan perkawinan pada kasus tersebut. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis normatif dengan spesifikasi penelitian preskriptif analitis. Sumber data yang digunakan adalah data sekunder dengan metode pengumpulan data menggunakan studi kepustakaan yang disajikan dalam bentuk teks naratif dengan metode analisis normatif kualitatif . Berdasarkan hasil penelitian dan analisa data dapat disimpulkan bahwa pertimbangan hukum hakim pada Putusan Nomor 751/Pdt.G/2023/PA.Kab.Kdr hanya mendasarkan pada Pasal 22 Undang-Undang Nomor 1 Tahun 1974 jo Pasal 71 huruf a Kompilasi Hukum Islam. Menurut penulis, untuk memperkuat putusan tersebut hakim dapat menambahkan Pasal 3 Undang-Undang Nomor 1 Tahun 1974 dan Pasal 9 Undang-Undang Nomor 1 Tahun 1974 serta Pasal 23 huruf c Undang-Undang Nomor 1 Tahun 1974 jo Pasal 73 huruf c Kompilasi Hukum Islam sebagai pertimbangan hukumnya. Akibat hukum atas pembatalan perkawinan terhadap perkara ini adalah putusnya hubungan suami istri antara Termohon I dan Termohon II. Sehingga status diri Termohon I dan Termohon II kembali seperti semula dimana keduanya seolah-olah tidak pernah melangsungkan perkawinan. |
| Abtrak (Bhs. Inggris) | Marriage cancellation is the cancellation of a marriage because it does not fulfill the conditions for a valid marriage. One of the causes of marriage cancellation is because of the identity forgery, as in the case regarding the marriage cancellation at the Kediri Regency Religious Court Decision Number 751/Pdt.G/2023/PA.Kab.Kdr. The cancellation of marriage in this case occured due to identity forgery by Respondent I who claimed to be unmarried young man, when in reality he still had the status of the legal husband of another woman. The study aims to find out the basic legal considerations of judges in deciding cases for cancellation of marriage in decision number 751/Pdt.G/2023/PA.Kab.Kdr and to find out the legal consequences of cancellation of marriage in that case. The reseacrh method used is normative juridical with prescriptive analytical research specifications. The data source used is secondary data with data collection method using on literature studies which is presented in the form of narrative text with analysis method qualitative normative. Based on the result of the research and data analysis, it can be concluded that the legal considerations of the judges in Decision Number 751/Pdt.G/2023/PA.Kab.Kdr. are only based on Article 22 of Law Number 1 of 1974 in conjuction with Article 71 letter a Compilation of Islamic Law. According to the researcher, to strengthen the decision the judge can add Article 3 of Law Number 1 of 1974 and Article 9 of Law Number 1 of 1974 and also Article 23 letter c of Law Number 1 of 1974 in conjuction with Article 73 letter c Compilation of Islamic Law. The legal consequence of marriage cancellation in this case is the termination of the husband and wife relationship between Respondent I and Respondent II. So that the status of the first and second respondent returned into its original status, as if they had never been married. |
