| Abstrak (Bhs. Indonesia) | Kecelakaan lalu lintas merupakan perbuatan yang dapat diancam dengan pidana penjara. Namun, pada prakteknya, tidak semua tindak pidana kecelakaan lalu lintas diselesaikan melalui jalur peradilan. Di sini peran penyidik adalah mengungkap kronologis kejadian, menemukan penyebab kejadian, menentukan apakah kasus tersebut akan dilanjutkan ataukah akan diselesaikan melalui keadilan restoratif. Penelitian ini bertujuan untuk menganalisis pengaturan dan dasar hukum Restorative Justice dan peran penyidik dalam penanganan tindak pidana kecelakaan lalu lintas di Satlantas Polres Indramayu, faktor-faktor yang mempengaruhi peran penyidik dalam penanganan tindak pidana kecelakaan lalu lintas di Satlantas Polres Indramayu sekaligus peran penyidiknya. Metode pendekatan yang digunakan adalah yuridis sosiologis, spesifikasi penelitian deskriptif analitis. Data yang digunakan adalah data primer dan data sekunder. Metode pengumpulan data dilakukan dengan wawancara di Polres Indramayu yang disajikan secara teks naratif. Metode analisis data menggunakan analisis kualitatif. Hasil penelitian menunjukkan bahwa pengaturan dan dasar hukum yang digunakan adalah Perpolri Nomor 8 Tahun 2021 tentang Penanganan Tindak Pidana Berdasarkan Keadilan Restoratif. Faktor-faktor yang mempengaruhi peran penyidik dalam penanganan tindak pidana kecelakaan lalu lintas di Satlantas Polres Indramayu adalah faktor Perundang-undangan atau faktor hukumnya sendiri, faktor penegak hukum, faktor sarana dan prasarana. Saran: 1) meningkatkan sosialisasi pemahaman kepada masyarakat tentang konsep Restorative Justice sehingga masyarakat memahami dengan baik penyelesaian atas kasus hukum yang terjadi maupun dialami. 2) Masyarakat diharapkan kedepannya lebih koperatif terhadap masalah hukum yang dialami sehingga sistem hukum yang berlaku dapat berjalan dengan optimal. |
| Abtrak (Bhs. Inggris) | Traffic accidents are acts that are punishable by imprisonment. However, in practice, not all traffic accidents are resolved through judicial channels. Here the role of the investigator is to reveal the chronology of the incident, find the cause of the incident, determine whether the case will continue or will be resolved through restorative justice. This study aims to analyze the regulation and legal basis of Restorative Justice and the role of investigators in handling criminal traffic accidents at the Indramayu Police Traffic Unit, factors that influence the role of investigators in handling criminal traffic accidents at the Indramayu Police Traffic Unit as well as the role of investigators. The approach method used is juridical sociological, analytical descriptive research specifications. The data used are primary data and secondary data. The data collection method was carried out by interviewing at Indramayu Police Station which was presented in narrative text. The data analysis method uses qualitative analysis. The results showed that the regulation and legal basis used was Police Regulation Number 8 of 2021 concerning Handling Crimes Based on Restorative Justice. The factors that influence the role of investigators in handling traffic accident crimes at the Indramayu Police Traffic Unit are the legal factors themselves (Legislation), law enforcement factors, facilities and infrastructure factors. Suggestions: 1) increase the socialization of understanding to the public about the concept of Restorative Justice so that people understand well the resolution of legal cases that occur or are experienced. 2) The community is expected in the future to be more cooperative with legal problems experienced so that the applicable legal system can run optimally. |
