Indonesia) | Proses penegakkan hukum pidana saat ini telah mengenal penyelesaian perkara tindak pidana dengan mengedepankan restorative justice yang menekankan pemulihan kembali pada keadaan semula agar terciptanya suatu keseimbangan perlindungan, sehingga kepentingan korban dan pelaku tindak pidana tidak hanya berorientasi pada pembalasan, namun lebih mengarah kepada upaya penyelesaian perkara di luar pengadilan. Kejaksaan Negeri Kota Banjar sebagai salah satu aparat penegak hukum mempunyai tugas dan kewenangan untuk menerapkan restorative justice tersebut. Tujuan Penelitian ini adalah untuk mengetahui peran dari Kejaksaan Negeri Kota Banjar dalam pelaksanaan penyelesaian perkara melalui restorative justice terhadap tindak pidana penggelapan serta hambatan-hambatan yang dialami oleh Kejaksaan Negeri Kota Banjar dalam menerapkan restorative justice tersebut. Penelitian ini menggunakan metode pendekatan yuridis empiris dengan spesifikasi penelitian deskriptif analitis. Lokasi penelitian di Kejaksaan Negeri Kota Banjar. Metode penentuan informan dalam penelitian ini menggunakan teknik Purposive Sampling. Sumber data yang digunakan adalah data primer dan data sekunder. Data diolah dengan reduksi data, penyajian data dan kategorisasi data serta dianalisis dengan teknik Content Analisys Methode. Berdasarkan hasil penelitian dan pembahasan maka dapat disimpulkan bahwa Kejaksaan Negeri Kota Banjar berperan sebagai fasilitator yang mana tercantum dalam Pasal 9 Peraturan Kejaksaan Nomor 15 Tahun 2020 Tentang Penghentian Penuntutan Berdasarkan Keadilan Restoratif. Merujuk pada peran tersebut dinilai masih belum maksimal dengan ditemukannya hambatan-hambatan yang dialami oleh Kejaksaan Negeri Kota Banjar baik itu hambatan internal, eksternal maupun faktor penghambat lainnya. Hambatan-hambatan tersebut harus segera dibenahi agar penerapan restorative justice yang dijalankan oleh Kejaksaan Negeri Kota Banjar dapat berjalan maksimal. |

Inggris) | The current criminal law enforcement process has recognized the settlement of criminal cases by prioritizing restorative justice, which emphasizes restoring back to the original state, in order to create a balance of protection so that the interests of victims and perpetrators of criminal acts are not only oriented towards retaliation, but more towards efforts to resolve cases outside the court.. The Banjar City State Attorney's Office as one of the law enforcement officials has the duty and authority to implement restorative justice. The purpose of this study is to determine the role of the Banjar City District Attorney's Office in the implementation of case settlement through restorative justice for embezzlement crimes and the obstacles experienced by the Banjar City District Attorney's Office in implementing restorative justice. This research uses an empirical juridical approach method with analytical descriptive research specifications. The research location is at the Banjar City District Attorney's Office. The method of determining informants in this research uses purposive sampling technique. The data sources used are primary data and secondary data. The data was processed by data reduction, data presentation and data categorization and analyzed using the Content Analysis Method technique. Based on the results of research and discussion, it can be concluded that the Banjar City District Attorney's Office acts as a facilitator which is stated in Article 9 of Prosecutor's Regulation Number 15 of 2020 concerning Termination of Prosecution Based on Restorative Justice. Referring to this role, it is still considered not optimal with the obstacles experienced by the Banjar City District Prosecutor's Office, be it internal, external or other inhibiting factors. These obstacles must be addressed immediately so that the application of restorative justice carried out by the Banjar City District Attorney's Office can run optimally. |
