| Abstrak (Bhs. Indonesia) | Perlindungan konsumen telah mengatur hak-hak dan kewajiban konsumen dan pelaku usaha yang tertuang dalam Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Salah satu contoh kasus dalam hal ini adalah adanya tindakan pelaku usaha yang melanggar hak-hak konsumen, kewajiban, serta perbuatan yang dilanggar bagi pelaku usaha dengan menperdagangkan Gas LPG yang tidak sesuai berat bersih. Perbuatan tersebut telah menimbulkan kerugian bagi konsumen karena Gas LPG yang diperdagangkan tidak memenuhi ketentuan standar mutu barang sehingga menimbulkan kerugian bagi konsumen. Tujuan dari penelitian ini adalah untuk mengetahui perlindungan hukum terhadap konsumen Gas LPG yang tidak sesuai berat bersih berdasarkan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Penelitian ini dilakukan dengan menggunakan metode yuridis normatif dengan spesifikasi penelitian deskriptif analisis. Sumber data yang digunakan adalah bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Data yang diperoleh disajikan dengan teks naratif sistematis dan metode analisis data yang digunakan adalah metode normatif kualitatif. Berdasarkan hasil penelitian dan pembahasan dapat disimpulkan bahwa konsumen telah memperoleh perlindungan hukum dengan dijatuhkannya hukuman bagi pelaku usaha berdasarkan ketentuan Pasal 8 huruf b dan c Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Majelis hakim juga menyatakan Parman Bin Supria terbukti bersalah karena memperdagangkan Gas LPG yang tidak sesuai berat bersih yang dinyatakan dalam label atau etiket barang. |
| Abtrak (Bhs. Inggris) | Consumer protection has regulated the rights and obligations of consumers and business actors as stipulated in Law Number 8 of 1999 concerning Consumer Protection. One example of a case in this case is the actions of business actors who violate consumer rights, obligations, and actions that are violated for business actors by trading LPG Gas that is not in accordance with the net weight. This action has caused losses to consumers because the LPG Gas traded does not meet the provisions of the quality standards of goods, causing losses to consumers. The purpose of this study is to determine the legal protection of LPG Gas consumers who do not match the net weight based on Law Number 8 of 1999 concerning Consumer Protection. This research was conducted using normative juridical methods with descriptive research specification analysis. The data sources used are primary legal materials, secondary legal materials, and tertiary legal materials. The data obtained are presented with systematic narrative texts and the data analysis method used is a qualitative normative method. Based on the results of research and discussion, it can be concluded that consumers have obtained legal protection by imposing penalties for business actors based on the provisions of Article 8 letter b and c of Law Number 8 of 1999 concerning Consumer Protection. The panel of judges also found Parman Bin Supria guilty of trading LPG Gas that did not match the net weight stated in the label or etiquette of goods. |
