Abstrak (Bhs. Indonesia)Dalam suatu hubungan kerja seringkali terjadi perselisihan. Menurut Pasal 3 ayat (1) Undang-Undang Nomor 2 Tahun 2004 tentang Penyelesaian Perselisihan Industrial dijelaskan bahwa apabila terjadi perselisihan hubungan industrial maka wajib diupayakan penyelesaian terlebih dahulu melalui perundingan bipartit secara musyawarah untuk mufakat. Bahwa hasil penyelesaian bipartit yang telah selesai ini selanjutnya disebut perjanjian bersama ditandatangani oleh kedua belah pihak. Dalam pelaksanaannya berdasarkan Putusan Nomor 262/Pdt.Sus-PHI/201/PN Mdn, Penggugat bernama Saelan Hasanuddin mengajukan gugatan kepada perusahaannya yaitu PT. Tolan Tiga Indonesia atas Pemutusan Hubungan Kerja yang dilakukan secara sepihak. Dalam prosesnya PT Tolan Tiga Indonesia menolak seluruh pernyataan yang disampaikan Penggugat dan menyatakan bahwa sebelum berakhirnya hubungan kerja, telah dilakukan perundingan bipartit yang menghasilkan perjanjian bersama dan telah didaftarkan Pengadilan Hubungan Industrial sehingga peneliti bermaksud untuk mengkaji pertimbangan hukum hakim mengenai pelanggaran terhadap perjanjian bersama dalam perkara tersebut serta bentuk pertanggungjawaban hukum pelanggaran perjanjian bersama bagi para pihak.
Metode yang digunakan adalah yuridis normatif, dengan pendekatan perundangundangan, kasus serta analisis, spesifikasi penelitian preskriptif dengan data bersumber pada data sekunder yang dianalisis dengan normatif kualitatif dan metode penyajian berbentuk naratif. Berdasarkan hasil penelitian bahwa pertimbangan hukum hakim dalam Putusan Nomor 262/Pdt.Sus-PHI/2018/PN Mdn terdapat pelanggaran yang dilakukan oleh Saelan Hasanuddin terhadap perjanjian bersama yang telah mempunyai kekuatan hukum tetap. Bentuk pertanggungjawaban hukum pelanggaran perjanjian bersama berupa pelaksanaan Perjanjian Bersama yang telah disepakati keduanya.
Abtrak (Bhs. Inggris)In a work relationship often occurs of disputes. According to Article 3 paragraph (1) of Law Number 2 of 2004 concerning Industrial Dispute Settlement, it is explained that in the event of an industrial relations dispute, it is obligatory to seek a settlement first through bipartite negotiations by deliberation for consensus. The result of the completed bipartite settlement here is referred to as a joint agreement in which the agreement was signed by both parties. In its implementation in the case of Decision Number 262/Pdt.Sus-PHI/201/PN Mdn, the Plaintiff named Saelan Hasanuddin filed a lawsuit against his company, namely PT. Tolan Tiga Indonesia for Termination of Employment, which was carried out unilaterally. In the process, PT Tolan Tiga Indonesia rejected all statements submitted by the Plaintiff and stated that before the end of the working relationship between them, bipartite negotiations had been carried out which resulted in a collective agreement and had been registered at the Industrial Relations Court, so the researcher intends to examine the judge's legal considerations regarding violations of the collective agreement in the case as well as forms of legal responsibility for violations of the collective agreement for the parties.
The method used is normative juridical, with a statutory, case, and analysis approach, prescriptive research specifications with data sourced from secondary data which are analyzed using qualitative normative and narrative presentation methods. Based on the results of the study, the judge's legal considerations in Decision Number 262/Pdt.Sus-PHI/2018/PN Mdn contained violations committed by Saelan Hasanuddin because he had violated a collective agreement that had permanent legal force. In the form of legal responsibility for violations of the collective agreement, Saelan Hasanuddin must be held accountable for his actions by the Collective Agreement that both agreed upon.
