| Abstrak (Bhs. Indonesia) | Indonesia belum mengatur mengenai perubahan status ganti jenis kelamin saat seseorang ingin mengajukan hal tersebut hakim tidak boleh menolaknya sebab hakim dianggap tahu akan segalanya berdasarkan hal tersebut tentunya hal ini akan mengacu pada Pasal 10 ayat (1) Undang-Undang Nomor 48 Tahun 2009 tentang Kekuasaan Kehakiman bahwa pengadilan dilarang menolak untuk memeriksa, mengadili, dan memutus suatu perkara yang diajukan dengan dalih bahwa hukum tidak ada atau kurang jelas, melainkan wajib untuk memeriksa dan mengadilinya. Caranya adalah berpedoman dengan ketentuan Pasal 5 ayat (1) Undang-Undang Nomor 48 Tahun 2009 tentang Kekuasaan Kehakiman, yakni Hakim dan hakim konsitusi wajib menggali, mengikuti, dan memahami nilai-nilai hukum dan rasa keadilan yang hidup dalam masyarakat. Tujuan dari penelitian ini yaitu: (1). Untuk mengetahui pertimbangan hukum hakim yang menolak permohonan perubahan ganti jenis kelamin dalam penetapan nomor 30/Pdt.P/2022/PN.Pwt. (2). Untuk mengetahui akibat hukum dengan ditolaknya permohonan perubahan ganti jenis kelamin dalam penetapan nomor 30/Pdt.P/2022/PN.Pwt. Metode yang digunakan dalam penelitian ini adalah penelitian Yuridis Normatif dengan spesifikasi penelitian Preskriptif. Sumber data yang digunakan adalah bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Data yang diperoleh disajikan dengan teks naratif sistematis, dan metode analisis data yang digunakan adalah metode normatif kualitatif. Berdasarkan hasil penelitian dan pembahasan dalam Penetapan Nomor 30/Pdt.P/2022/PN.Pwt dapat disimpulkan bahwa: pertama, pertimbangan hukum hakim yang menolak permohonan pemohon karena pemohon tidak mampu membuktikan dalil permohonannya sehingga hakim menilai berdasarkan keterangan dua orang saksi dan keterangan ahli spesialis bedah pelastik dan ahli psikiater. Kedua, akibat hukum dengan ditolaknya permohonan perubahan ganti jenis kelamin dalam penetapan nomor 30/Pdt.P/2022/PN.Pwt maka Faqih Al Amien maka status jenis kelaminnya tetap laki-laki dan tidak ada perubahan. |

Inggris) | Indonesia has not yet regulated a change in gender change status when someone wants to submit a matter, the judge may not reject it because the judge is deemed to know everything based on this, of course this will refer to Article 10 paragraph (1) of Law Number 48 of 2009 concerning Judicial Power that the court is prohibited from refusing to examine, try and decide on a case submitted on the pretext that the law does not exist or is unclear, but is obliged to examine and adjudicate it. This method is guided by the provisions of Article 5 paragraph (1) of Law Number 48 of 2009 concerning Judicial Power, namely that judges and constitutional judges are obliged to explore, follow, and understand legal values and a sense of justice that lives in society. The aims of this research are: (1). To find out the legal considerations of the judge who rejected the request for a change of sex in determining number 30/Pdt.P/2022/PN.Pwt. (2). To find out the legal consequences of rejecting an application for a change of sex in the determination of number 30/Pdt.P/2022/PN.Pwt. The method used in this research is normative juridical research with prescriptive research specifications. The data sources used are primary legal materials, secondary legal materials, and tertiary legal materials. The data obtained is presented in a systematic narrative text, and the data analysis method used is qualitative normative method. Based on the results of the research and discussion in Determination Number 30/Pdt.P/2022/PN.Pwt it can be concluded that: first, the legal considerations of the judge who rejected the applicant's application because the applicant was unable to prove the argument for his application so that the judge assessed based on the testimony of two witnesses and the testimony of a plastic surgeon and a psychiatrist. Second, due to the rejection of the request for change of sex in the determination of number 30/Pdt.P/2022/PN.Pwt, Faqih Al Amien's gender status is still male and there is no change. |
