| Abstrak (Bhs. Indonesia) | Tindak pidana korupsi sebagai white collar crime merupakan salah satu kejahatan yang luar biasa (extra ordinary crime) yang dilakukan secara sistematis dan terorganisir. Para penegak hukum seringkali mengalami kesulitan dalam dalam mengungkap pelaku tindak pidana korupsi. Salah satu upaya untuk memberantasnya yaitu dengan bantuan justice collaborator. Namun, tidak sedikit permohonan justice collaborator yang ditolak oleh Majelis Hakim. Penelitian ini mengkaji tentang pertimbangan hukum hakim yang menolak permohonan terdakwa sebagai justice collaborator dalam Putusan Nomor: 7/Pid.Sus-Tpk/2021/PN.Mdn dan akibat hukum dengan ditolaknya permohonan justice collaborator bagi terdakwa atas nama Agusman Sinaga berdasarkan Putusan Nomor: 7/Pid.Sus-Tpk/2021/PN.Mdn. Penelitian ini menggunakan metode pendekatan yuridis normatif dengan spesifikasi penelitian preskriptif. Sumber data yang digunakan adalah data sekunder dengan pengumpulan data menggunakan studi kepustakaan yang disajikan melalui uraian secara sistematis dan logis dengan bentuk teks naratif, dan dianalisis secara normatif kualitatif. Hasil penelitian menunjukan bahwa syarat justice collaborator yang terdapat dalam SEMA Nomor 4 Tahun 2011 bersifat kumulatif, dengan kata lain harus terpenuhi secara keseluruhan oleh pelaku tindak pidana. Majelis hakim dalam menolak permohonan justice collaborator terdakwa Agusman sudah tepat karena terdakwa tidak memenuhi ketentuan yang terdapat dalam angka 9 huruf b SEMA Nomor 4 Tahun 2011 yaitu permohonan justice collaborator tidak dimuat dalam tuntutan jaksa penuntut umum. Dengan ditolaknya status justice collaborator, maka akibatnya hukumnya bagi terdakwa yaitu tidak memperoleh keringanan hukuman dan tidak mendapatkan perlindungan dari Lembaga Perlindungan Saksi dan Korban. |

| Abtrak (Bhs. Inggris) | Corruption as white-collar crime is one of the extraordinary crimes (extraordinary crimes) committed systematically and organized. Law enforcement officers often have trouble uncovering the perpetrators of corruption. One attempt to eliminate it was with the help of a justice collaborator. However, not a few requests from justice collaborators were rejected by the Chamber of Judges. This study examined the legal considerations of a judge who rejected the application of the accused as a justice collaborator in the Judgment Number: 7/Pid.Sus-Tpk/2021/PN.Mdn and the legal consequences of the rejection of the application for a justice collaborator for an accused on behalf of Agusman Sinaga on the basis of the judgment Number: 7/Pid.Sus-Tpk/2021/PN.Mdn. This research uses a normative juridical approach with prescriptive research specifications. The data sources used are secondary data collected using library studies, presented through systematic and logical descriptions in the form of narrative text, and analyzed qualitatively and normatively. The results of the research showed that the requirement of a justice collaborator contained in SEMA Number 4 of 2011 is cumulative, in other words, it must be met overall by the offenders. Judge Assembly's rejection of the application of justice collaborator accused Agusman has been accurate because the accused did not meet the provisions contained in the number 9 letter b of SEMA Number 4 of 2011, that is, the request of the justice collaborator is not loaded in the public prosecutor's lawsuit. By denying the status of a justice collaborator, the legal consequence for the accused is that he does not obtain a sentence and does not receive protection from the Institute for the Protection of Witnesses and Victims. |
