Indonesia) | Kemajuan teknologi yang begitu pesat menimbulkan adanya pergantian aktivitas kehidupan manusia dalam berbagai bidang, yang secara langsung sudah mempengaruhi lahirnya berbagai bentuk perbuatan hukum yang juga baru. Salah satunya merupakan kegiatan memperbanyak karya cipta film lewat internet tanpa izin pencipta. Hal ini tentu merugikan pemegang hak cipta sinematografi yang seharusnya mendapatkan hak ekonomi berupa royalti. Salah satu contoh kasusnya terdapat dalam Putusan Nomor 762/Pid.Sus/2020/Pn-Jmb. Tujuan penelitian ini adalah untuk mengetahui bagaimana perlindungan hukum terhadap pemegang hak cipta sinematografi atas hasil penayangan film layar lebar dan akibat hukum terhadap pelanggaran hak cipta sinematografi atas hasil penayangan film layar lebar berdasarkan Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta. Penelitian ini menggunakan metode pendekatan yuridis normatif dengan spesifikasi penelitian deskriptif analitis. Sumber data yang digunakan dalam penelitian ini yaitu sumber data sekunder berupa bahan hukum primer, sekunder, dan tersier yang dikumpulkan melalui metode studi kepustakaan. Data tersebut kemudian diolah serta dianalisis menggunakan metode normatif kualitatif dan disajikan dalam bentuk teks naratif. Berdasarkan hasil penelitian dan pembahasan dapat disimpulkan bahwa Majelis Hakim dalam putusan a quo telah memberikan perlindungan hukum terhadap pemegang hak cipta sesuai dengan ketentuan pasal Pasal 113 Ayat (3) Jo Pasal 9 Ayat (1) huruf a, huruf b, huruf e, dan/atau huruf g Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta Jo Pasal 55 Ayat (1) ke-1 KUHP, dan menimbulkan akibat hukum dengan dijatuhi pidana penjara selama 1 (satu) tahun dan 2 (dua) bulan serta denda sebesar Rp500.000.000,00 (lima ratus juta rupiah). |

Inggris) | Technological advances that are so rapid have led to changes in human life activities in various fields, which have directly influenced the birth of various forms of legal actions that are also new. One of them is the activity of reproducing film copyright works via the internet without the creator's permission. This is of course detrimental to cinematographic copyright holders who should receive economic rights in the form of royalties. One example of the case is found in Decision Number 762/Pid.Sus/2020/Pn-Jmb. The purpose of this study is to find out how the legal protection for cinematographic copyright holders for the results of feature films is shown and the legal consequences for cinematographic copyright infringement on the results of wide-screen based on Law Number 28 of 2014 concerning Copyright. This study uses a normative juridical approach with analytical descriptive research specifications. The data sources used in this study are secondary data sources in the form of primary, secondary, and tertiary legal materials collected through library research methods. The data is then processed and analyzed using qualitative normative methods and presented in the form of narrative text. Based on the results of the research and discussion, it can be concluded that the Panel of Judges is in the decision quo has provided legal protection to copyright holders in accordance with the provisions of Article 113 Paragraphs (3) Jo Article 9 Paragraph (1) letter a, letter b, letter e, and/or letter g of Law Number 28 of 2014 Concerning Copyrights Jo Article 55 Paragraph (1) 1st of the Criminal Code, and creates legal consequences of being sentenced to imprisonment for 1 (one) year and 2 (two) months and a fine of Rp. 500,000,000.00 (five hundred million rupiahs) |
