Indonesia) | Dalam perdagangan barang atau jasa, merek sebagai salah satu bentuk karya intelektual yang memiliki peranan penting bagi kelancaran dan peningkatan perdagangan barang atau jasa. Pendaftaran merek merupakan salah satu bentuk perlindungan hukum bagi pemilik merek terdaftar. Persaingan usaha yang semakin ketat dan meningkat menyebabkan pelaku usaha melakukan kecurangan dengan meniru merek pihak lain demi mendapatkan keuntungan. Penelitian ini bertujuan untuk mengetahui bagaimana pembatalan merek C dalam Putusan Mahkmah Agung Nomor 1111 K/Pdt.Sus-HKI/2022 dan akibat hukum terhadap pembatalan merek C berdasarkan Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis. Penelitian ini menggunakan metode pendekatan yuridis normatif dengan spesifikasi penelitian deskriptif analitis. Sumber data yang digunakan adalah data sekunder yang terdiri dari bahan hukum primer, sekunder, dan tersier. Metode pengumpulan data dilakukan dengan studi kepustakaan, kemudian data yang diperoleh disajikan dalam bentuk teks naratif dengan menggunakan metode analisis data yang digunakan yaitu metode normatif kualitatif. Berdasarkan data hasil penelitian dan pembahasan dapat disimpulkan bahwa pembatalan merek C milik Tergugat dalam Putusan Mahkamah Agung Nomor 1111 K/Pdt.Sus-HKI/2022 sesuai dengan ketentuan yang diatur dalam Pasal 21 ayat (1) huruf a dan ayat (3) Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis. Akibat hukum pembatalan merek C milik Tergugat yaitu Turut Tergugat mencabut hak atas merek C milik tergugat, mencoret merek C milik Tergugat dari Daftar Umum Merek serta diumumkan dalam Berita Resmi Merek oleh Direktorat Jenderal Kekayaan Intelektual. |
| Abtrak (Bhs. Inggris) | In the trade of goods or services, trademark as one form of intellectual work that has an important role for the smooth and increased trade in goods or services. Trademark registration is one form of legal protection for registered trademark owners. Increasingly fierce business competition causes business actors to commit fraud by imitating other parties' trademarks for profit. This research aims to find out how the cancellation of the C trademark in the Supreme Court Decision Number 1111 K/Pdt.Sus-HKI/2022 and the legal consequences of the cancellation of the C trademark based on Law Number 20 of 2016 concerning Trademarks and Geographical Indications. This research uses a normative juridical approach method with analytical descriptive research specifications. The data source used is secondary data consisting of primary, secondary, and tertiary legal materials. The data collection method is carried out by literature study, then the data obtained is presented in the form of narrative text using the data analysis method used, namely the qualitative normative method. Based on the research and discussion data, it can be concluded that the cancellation of the Defendant's C trademark in Supreme Court Decision Number 1111 K/Pdt.Sus-HKI/2022 is in accordance with the provisions stipulated in Article 21 paragraph (1) letter a and paragraph (3) of Law Number 20 of 2016 concerning Trademarks and Geographical Indications. The legal consequences of the cancellation of the Defendant's C trademark are that the Defendant revoked the rights to the Defendant's C trademark, crossed out the Defendant's C trademark from the General Register of Trademarks and announced in the Trademark Official Gazette by the Directorate General of Intellectual Property. |
