| Judul Artikel | PERLINDUNGAN HUKUM TERHADAP MEREK TERKENAL MASTERTINT BERDASARKAN UNDANG-UNDANG NOMOR 20 TAHUN 2016 TENTANG MEREK DAN INDIKASI GEOGRAFIS DALAM PUTUSAN MAHKAMAH AGUNG REPUBLIK INDONESIA NOMOR : 1082 K/Pdt.Sus-HKI/2022 |
| Abstrak (Bhs. Indonesia) | Peranan merek menjadi sangat penting dalam menjaga persaingan usaha yang sehat di era perdagangan global. Namun, pada praktiknya merek terkenal sering kali dimanfaatkan tanpa izin oleh pihak lain sehingga berpotensi menimbulkan kerugian terhadap pemilik merek sah. Oleh karena itu, merek terkenal harus mendapatkan perlindungan hukum dari negara agar terhindar dari pelanggaran merek yang dapat merugikan para pihak. Penelitian ini bertujuan untuk mengetahui bagaimana perlindungan hukum terhadap merek terkenal MASTERTINT berdasarkan Undang-Undang Nomor 20 Tahun 2016 tentang Merek Dan Indikasi Geografis dalam Putusan Mahkamah Agung Republik Indonesia Nomor : 1082 K/Pdt.Sus-HKI/2022 dan akibat hukum pembatalan merek MasterTint dalam Putusan Mahkamah Agung Republik Indonesia Nomor : 1082 K/Pdt.Sus-HKI/2022. Penelitian ini menggunakan metode pendekatan yuridis normatif dengan spesifikasi penelitian deskriptif analitis. Sumber data yang digunakan adalah data sekunder yang dikumpulkan dengan studi kepustakaan, kemudian dianalisis menggunakan metode normatif kualitatif dan disajikan dalam bentuk teks naratif. Berdasarkan data hasil penelitian dan pembahasan menunjukkan bahwa Majelis Hakim telah memberikan perlindungan hukum terhadap merek MASTERTINT milik Penggugat dengan melakukan pembatalan merek MasterTint milik Tergugat dalam Putusan Mahkamah Agung Nomor 1082 K/Pdt.Sus-HKI/2022 sesuai dengan ketentuan yang diatur dalam Pasal 21 ayat (1) huruf a, b dan (3) Undang-Undang Nomor 20 Tahun 2016 Tentang Merek dan Indikasi Geografis. Akibat hukum yang timbul dari pembatalan merek MasterTint milik Tergugat yaitu merek tersebut dicoret dari Daftar Umum Merek yang diumumkan dalam Berita Resmi Merek oleh Direktorat Jenderal Kekayaan Intelektual. |
| Abtrak (Bhs. Inggris) | The role of brands is very important in maintaining fair business competition in the era of global trade. However, in practice, well-known brands are often used without permission by other parties, which has the potential to cause harm to the legal brand owner. Therefore, well-known brands must receive legal protection from the state in order to avoid trademark infringement which can be detrimental to the parties. This study aims to find out how the legal protection of the famous MASTERTINT brand is based on Law Number 20 of 2016 concerning Marks and Geographical Indications in the Supreme Court of the Republic of Indonesia Number: 1082 K/Pdt.Sus-HKI/2022 and the legal consequences of canceling the MasterTint brand in Decision of the Supreme Court of the Republic of Indonesia Number: 1082 K/Pdt.Sus-HKI/2022. This study uses a normative juridical approach with analytical descriptive research specifications. The data source used is secondary data collected by means of library research, then analyzed using qualitative normative methods and presented in the form of narrative text. Based on the research and discussion data, it shows that the Panel of Judges has provided legal protection for the Plaintiff's MASTERTINT brand by canceling the Defendant's MasterTint brand in the Supreme Court Decision Number 1082 K/Pdt.Sus-HKI/2022 in accordance with the provisions stipulated in Article 21 paragraph (1) letters a, b and (3) Law Number 20 of 2016 Concerning Marks and Geographical Indications. The legal consequence arising from the cancellation of the Defendant's MasterTint mark was that the mark was removed from the General Register of Marks which was announced in the Official Mark Gazette by the Directorate General of Intellectual Property. |
