| Abstrak (Bhs. Indonesia) | Merek merupakan salah satu bagian dari Hak Kekayaan Intelektual yang memiliki perlindungan hukum. Merek mempunyai peranan yang sangat penting dalam dunia perdagangan khususnya dalam hal pemasaran produk karena konsumen sering mengaitkan kualitas, atau reputasi barang dan jasa dengan merek. Pendaftaran merek dilakukan sebagai bentuk perlindungan hukum terhadap pemilik merek terdaftar. Persaingan usaha yang semakin meningkat menyebabkan beberapa pelaku usaha menempuh jalan instan agar merek yang dimiliki mudah untuk laku dipasaran dengan meniru merek milik pihak lain, terutama merek terkenal. Penelitian ini bertujuan untuk mengetahui bagaimana pembatalan pendaftaran Merek SUPER PROFILA dalam Putusan Nomor 999 K/Pdt.Sus-HKI/2022 serta akibat hukum pembatalan Merek SUPER PROFILA berdasarkan Undang-Undang Nomor 20 Tahun 2016 Tentang Merek dan Indikasi Geografis. Penelitian ini menggunakan metode pendekatan yuridis normatif dengan spesifikasi penelitian deskriptif analitis. Sumber data yang digunakan adalah data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Metode pengumpulan data dilakukan dengan studi kepustakaan, kemudian data yang diperoleh disajikan dalam bentuk teks naratif dan metode analitis data yang digunakan yaitu metode normatif kualitatif. Berdasarkan data hasil penelitian dan pembahasan dapat disimpulkan bahwa pembatalan merek SUPER PROFILA milik Tergugat dalam Putusan Nomor 999 K/Pdt.Sus-HKI/2022 sudah sesuai dengan ketentuan yang diatur dalam Pasal 21 ayat (1) huruf a,b dan ayat (3) Undang-Undang Nomor 20 Tahun 2016 Tentang Merek dan Indikasi Geografis. Akibat hukum pembatalan merek SUPER PROFILA milik Tergugat setelah adanya Putusan Nomor 999 K/Pdt.Sus-HKI/2022 adalah merek tersebut dicoret dari Daftar Umum Merek Direktorat Jenderal Kekayaan Intelektual. |

Brands have a very important role in the world of commerce, especially in terms of product marketing because consumers often associate the quality or reputation of goods and services with brands. Mark registration is carried out as a form of legal protection for registered mark owners. Increasing business competition has caused some business actors to take instant steps so that their brand is easy to sell in the market by imitating other people's well-known brands. This study aims to find out how the cancellation of the registration of the SUPER PROFILA Mark in Decision Number 999 K/Pdt.Sus-HKI/2022 and the legal consequences of canceling the SUPER PROFILA Mark based on Law Number 20 2016 concerning Brands and Geographical Indications. This study uses a normative juridical approach with analytical descriptive research specifications. The data source used is secondary data consisting of primary legal materials, secondary legal materials, and tertiary legal materials. The data collection method was carried out by means of a literature study, then the data obtained was presented in the form of narrative text and the data analytical method used was normative qualitative method. Based on the research and discussion data, it can be concluded that the cancellation of the SUPER PROFILA brand belonging to the Defendant in Decision Number 999 K/Pdt.Sus-HKI/2022 is in accordance with the provisions stipulated in Article 21 paragraph (1) letters a, b and paragraph (3) Law Number 20 of 2016 Concerning Trademarks and Geographical Indications. The legal consequence of canceling the SUPER PROFILA mark owned by the Defendant after the Decision Number 999 K/Pdt.Sus-HKI/2022 was that the mark was crossed out from the General Register of Trademarks of the Directorate General of Intellectual Property. |
