| Abstrak (Bhs. Indonesia) | ABSTRAK Penelitian ini bertujuan untuk memberikan informasi dan analisis lebih lanjut mengenai suatu sengketa kepegawaian pembebasan jabatan di kementerian agraria dan tata ruang / badan pertanahan nasional republik indonesia (tinjauan yuridis terhadap putusan pengadilan tata usaha negara nomor 9/G/2021/PTUN JKT). Metode penelitian yang digunakan dalam penelitian ini adalah yuridis normatif. Spesifikasi penelitian adalah preskriptif analitis. Metode pengumpulan bahan hukum adalah dengan pengumpulan bahan hukum primer dan sekunder melalui studi kepustakaan yang kemudian dianalisis dengan metode analisis kualitatif. Hasil penelitian menunjukkan bahwa ketentuan mengenai pembebasan jabatan di lingkungan Kementerian Agraria dan Tata Ruang Kepala Badan Pertanahan Nasional Republik Indonesia diatur dalam Peraturan Pemerintah Nomor 53 Tahun 2010 tentang Disiplin Pegawai Negeri Sipil yang saat ini diganti dengan Peraturan Pemerintah Nomor 94 Tahun 2021 tentang Disiplin Pegawai Negeri Sipil dikarenakan kasus terjadi sebelum dikeluarkannya Peraturan Pemerintah Nomor 94 Tahun 2021 tentang Disiplin Pegawai Negeri Sipil, maka pembebasan dari jabatan itu didasarkan menurut Peraturan Pemerintah Nomor 53 Tahun 2010 tentang Disiplin Pegawai Negeri Sipil yang merupakan sanksi disiplin berat, hal tersebut diatur dalam Pasal 7 ayat (4) huruf c Peraturan Pemerintah Nomor 53 Tahun 2010 tentang Disiplin Pegawai Negeri Sipil. Pertimbangan hukum hakim dalam memutus sengketa mutasi kepegawaian dalam putusan No. 9/G/2021/PTUN.Jkt yang dengan amar putusan menerima gugatan penggugat menggunakan 3 aspek yaitu aspek kewenangan, aspek prosedur dan aspek substansi. |

Inggris) | ABSTRACT This study aims to provide further information and analysis regarding an employment dispute regarding the release of positions at the ministry of agrarian and spatial planning / national land agency of the republic of Indonesia (juridical review of the state administrative court decision number 9/G/2021/PTUN JKT). The research method used in this research is normative juridical. The research specification is prescriptive analytical. The method of collecting legal materials is by collecting primary and secondary legal materials through literature studies which are then analyzed using qualitative analysis methods. The results of the study indicate that the provisions regarding the release from office within the Ministry of Agrarian Affairs and Spatial Planning of the Head of the National Land Agency of the Republic of Indonesia are regulated in Government Regulation Number 53 of 2010 concerning Civil Servant Discipline which is currently replaced by Government Regulation Number 94 of 2021 concerning Civil Servant Discipline because the case occurred before the issuance of Government Regulation Number 94 of 2021 concerning Civil Servant Discipline, then the release from office is based on Government Regulation Number 53 of 2010 concerning Civil Servant Discipline which is a severe disciplinary sanction, this is regulated in Article 7 paragraph (4) letter c of Government Regulation Number 53 of 2010 concerning Civil Servant Discipline. The judge's legal considerations in deciding the civil service mutation dispute in decision No. 9/G/2021/PTUN.Jkt, which with the verdict accepted the plaintiff's claim, used 3 aspects, namely aspects of authority, aspects of procedure and aspects of substance. |
