| Abstrak (Bhs. Indonesia) | Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan yang merupakan upaya unifikasi hukum mengenai pengaturan tata cara perkawinan dan akibat hukum perkawinan. Salah satu akibat dari perkawinan adalah pengaturan mengenai anak. Pasal 43 ayat (1) Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan menyebutkan bahwa anak luar kawin hanya mempunyai hubungan dengan ibunya saja. Ketentuan tersebut membawa dampak negatif terhadap anak luar kawin dalam kehidupan masyarakat. Selain itu perlindungan terhadap anak luar kawin belum terpenuhi akibat adanya pasal tersebut. Akibatnya pasal tersebut diajukan judicial review oleh Machica Mochtar ke Mahkamah Konstitusi. Pada tanggal 17 Februari 2012 Mahkamah Konstitusi mengeluarkan Putusan Nomor 46/PUU-VIII/2010 yang membatalkan ketentuan Pasal 43 ayat (1) Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan. Pasal 43 ayat (1) berubah menjadi anak luar kawin mempunyai hubungan dengan ibu serta ayah biologisnya sepanjang dapat dibuktikan dengan ilmu pengetahuan dan alat bukti menurut hukum. Perbedaan pasal 43 ayat (1) sebelum dan sesudah dirubah memiliki tujuan dan maksud yang berlainan terutama dalam hal perlindungan terhadap anak luar kawin. Hasil penelitian ini memberikan gambaran mengenai perbandingan Pasal 43 ayat (1) Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan dengan Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010 yang mengatur mengenai anak luar kawin. Selain itu dengan adanya putusan Mahkamah Konstitusi membawa pengaruh terhadap perlindungan anak luar kawin dimana selama ini anak luar kawin kurang mendapatkan perlindungan dari negara dalam hal pemenuhan hak-hak dasar anak sebagaimana mestinya sebagaimana dimanatkan dalam Undang-Undang. | Abtrak (Bhs. Inggris) | ABSTRACT Act no 1 of 1974 about Marriage which is the legal unification efforts on setting up procedures for marriage and the legal consequences of marriage. One of the effect of the marriage is a regulation of child. Article 43 paragraph (1) Act no 1 of 1974 about Marriage said that illegitimate children only have a relationship with his mother. Thats provision brings negatively affect towards to the illegitimate child in public life. Moreover, the protection to the illegitimate child not fulfilled because of that article. Consequently, that article submitted to judicial review by Machica Mochtar to the constitutional court. on the 17th of February 2012, the constitutional court issued a verdict number 46/PUU-VIII/2010 who cancelled the provision of article 43 paragraph (1) Act no 1 of 1974 about Marriage. The article 43 paragraph (1) changes into the illegitimate child have relationship with his mother and his biological’s father as long as it can be proven with science and evidence according to the law. The difference of article 43 paragraph (1) before and after its modified is have different goals and intentions especially in terms of protection to the illegitimate child. The result of this research gives description of the comparison between article 43 paragraph (1) Act no 1 of 1974 about Marriage and constitutional court verdict number 46/PUU-VIII/2010 who regulate the illegitimate child. Moreover, with the constitutional court verdict brings influence to the illegitimate child’s protection, wherever during this time, the illegitimate child get less protection from the state in the terms of fulfillment of the fundamental rights of the child as it should be mandated by the law.
