| Abstrak (Bhs. Indonesia) | Perampokan adalah suatu tindakan penggunaan kekerasan atau ancaman kekerasan untuk memaksa menyerahkan barang yang dimiliki korban kepada pelaku akibat dari kejahatan tersebut korban mengalami kerugian penderitaan berupa kerugian materill dan immaterial. Salah satu bentuk dari perlindungan hukum dengan memberikan restitusi oleh pelaku kepada korban dengan melibatkan sejumlah intansi aparat penegak hukum serta lembaga independen untuk menjamin pemberian restitusi kepada korban. Penelitian ini bertujuan untuk mengetahui pemenuhan hak-hak restitusi kepada korban dan faktor-faktor penghambat yang dialami korban dalam memenuhi hak restitusinya. Penelitian ini menggunakan metode penelitian kualitatif dengan socio legal approach dan spesifikasi penelitian deskriptif. Hasil penelitian menunjukan bahwa korban perampokan merupakan pihak yang terdampak langsung akibat dari kejahatan tersebut serta, menderita kerugian materil maupun imaterill pada pelaksanannya korban tidak mendapatkan restitusi sebagaimana diatur pada Undang-Undang Republik Indonesia Nomor 8 Tahun 1981 Tentang Hukum Acara Pidana, Undang-Undang Republik Indoneisa nomor 31 Tahun 2014 perubahan atas Undang-Undang Republik Indonesia nomor 13 Tahun 2006 tentang perlindungan saksi dan korban Peraturan Pemerintah Nomor 7 Tahun 2018 Jo. Peraturan Pemerintah Nomor 35 Tahun 2020 tentang Pemberian Kompensasi, Restitusi, dan Bantuan Kepada Saksi dan Korban Sistem Peradilan Pidana, Peraturan Mahasisa Nomor 1 Tahun 2022 Tata Cara Penyelesaian Permohonan Dan Pemberian Restitusi Dan Kompensasi Kepada Korban Tindak Pidana. Faktor yang menghambat pemberian restitusi yang dialami korban mulai dari aspek struktur hukum, aspek substansi hukum, aspek kultur hukum ketiganya merupakan hal yang berkaitan satu dengan lainnya. |

Inggris) | Robbery is an act of using violence or threats of violence to force the victim to surrender the beloges by the victim to the perpetrator as a result of the crime the victim suffers loss of suffering in the form of material and immaterial losses. One of a legal protection is to provide restitution by the perpetrator to the victim with the assistance of law enforcement officers. In providing restitution there is the involvement of a number of law enforcement agencies and independent institutions to guarantee the provision of restitution to victims. This research aims to find out how to fulfill the rights of victims regarding the provision of restitution to victims and the inhibiting factors faced by victims in obtaining restitution. This research uses qualitative research methods with a socio legal approach and descriptive research specifications. The results of the study show that the victims of robbery are the parties who are directly affected by the crime and suffer material and immaterial losses in its implementation, the victims do not get restitution as regulated in Law of the Republic of Indonesia Number 8 of 1981 concerning the Law of Criminal Procedure, Law of the Republic of Indonesia number 31 of 2014 amendments to the Law of the Republic of Indonesia Number 13 of 2006 concerning the Protection of Witnesses and Victims Government Regulation Number 7 of 2018 regarding the Provision of Compensation, Restitution, and Assistance to Witnesses and Victims of the Criminal Justice System Juncto Government Regulation Number 35 of 2022 Procedures for Completing Applications and Providing Restitution and Compensation to Victims of Crime regarding the. Factors that hinder the provision of restitution experienced by victims ranging from aspects of legal structure, aspects of legal substance, aspects of legal culture, all three are related to one another. |
