Indonesia) | Sidik jari dipakai oleh kepolisian dalam penyidikan untuk mengungkap kasus-kasus kejahatan, karena pada saat terjadinya suatu tindak pidana, tempat kejadian perkara akan diamankan dan dilarang bagi siapa saja untuk masuk karena dikhawatirkan akan merusak sidik jari pelaku yang tertinggal di barang bukti yang ada di tempat kejadian perkara. Penyelenggaraan sidik jari oleh Polri telah dikuatkan dengan Undang-Undang Nomor 2 Tahun 2002 Tentang Kepolisian Negara Republik Indonesia dan Undang-Undang Nomor 8 Tahun 1981 Tentang Hukum Acara Pidana. Penelitian ini menggunakan metode pendekatan yuridis sosiologis dengan pengumpulan data melalui wawancara, studi kepustakaan. Wawancara dilakukan kepada KABEO dan staf identifikasi Bapak Yanto dan Bapak Usup Supriadi di Polres Kota Banjar Patroman. Tujuan penelitian ini untuk mengetahui cara penyidik mengidentifikasi sidik jari untuk menentukan tersangka tindak pidana pembunuhan, serta factor yang menghambat penyidik pada saat mengidentifikasi sidik jari. Proses identifikasi sidik jari diawali dengan mencari bukti-bukti awal yakni salah satunya dengan mengambil sidik jari guna proses penyidikan awal kemudian hasil identifikasi dikembangkan melalui metode khusus oleh penyidik dan dibuat berita acara pemeriksaan yang menjelaskan mengenai identitas tersangka. Kekuatan hukum sidik jari dalam pembuktian adalah sebagai alat bukti petunjuk sebagaimana diatur dalam Pasal 184 ayat (1) butir (b) KUHAP dan Pasal 184 ayat (1) huruf c KUHAP. Factor penghambat dalam pelaksanaan identifikasi sidik jari dalam tindak pidana pembunuhan meliputi: factor hukum, factor penegak hukum, factor masyarakat dan factor budaya. This study uses a sociological juridical approach with data collection through interviews, literature studies. Interviews were conducted with KABEO and identification officers Mr. Yanto and Mr. Usup Supriadi at the Banjar Patroman City Police Station. The purpose of this study is to find out how investigators identify fingerprints to determine suspects in murder crimes, as well as the factors that hinder investigators from identification fingerprints. The fingerprint identification process begins with looking for initial evidence, one of which is taking fingerprints for the initial investigation process, then the results of the identification are developed through a special method by the investigator and an inspection report is made that explains the identity of the suspect. . The legal force of proof of fingerprints as evidence of instructions as regulated in Article 184 paragraph (1) letter b of the Criminal Procedure Code and Article 184 paragraph (1) letter c of the Criminal Procedure Code. Factors inhibiting the implementation of fingerprint identification in the crime of murder include: legal factors, law enforcement factors, community factors and cultural factors.
