| Abstrak (Bhs. Indonesia) | Penelitian ini bertujuan untuk mengetahui penerapan dan petimbangan hukum pidana Oleh hakim dalam putusan Nomor 205/Pid.Sus/2018/PN Pwt.,. Penelitian ini menggunakan metode pendekatan yuridis normatif Penulis akan mengkaji penerapan unsur-unsur tindak pidana karena kelalaiannya pada kecelakaan lalu lintas yang mengakibatkan orang lain meninggal dunia, selain itu melalui pendekatan normatif penulis mencoba menilai kesesuaian dasar pertimbangan hukum Majelis Hakim dalam penjatuhan pidana terhadap terdakwa dalam putusan Pengadilan Negeri Purwokerto Nomor: 205/Pid.Sus/2018/PN Pwt., sesuai dengan tujuan hukum pidana baik yang diatur dalam peraturan perundang-undangan maupun dalam kajian literatur. Temuan yang diperoleh dari penelitian ini, adalah majelis hakim yang memeriksa, mengadili dan memutuskan perkara ini telah menerapkan aturan hukum yang berlaku sesuai dengan ketentuan hukum pidana yang berlaku. Hal ini dapat ditunjukkan dengan melihat bahwa majelis hakim dalam memutuskan bahwa perbuatan terdakwa memenuhi unsur-unsur tindak pidana kelalaian lalu lintas sesuai dengan Pasal 310 ayat (4) UU RI No. 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan, didasarkan atas kebenaran materil yang diperoleh dari surat dakwaan, keteranganketerangan saksi, fakta-fakta dan bukti-bukti yang terungkap dalam proses persidangan. Pertimbangan hukum hakim dalam putusan Nomor 205/Pid.Sus/2018/PN Pwt., berdasarkan fakta-fakta yang timbul di persidangan menilai bahwa terdakwa dapat dipertanggungjawabkan atas perbuatan yang dilakukan dengan pertimbangan bahwa pada saat melakukan perbuatannya terdakwa lalai yang mengakibatkan kecelakaan lalu lintas dan mengakibatkan orang lain meninggal dunia. Ada unsur melawan hukum, serta tidak adanya alasan penghapusan kesalahan. |
| Abtrak (Bhs. Inggris) | This study aims to determine the application and consideration of criminal law by judges in the decision Number 205/Pid.Sus/2018/PN Pwt.,. This study uses a normative juridical approach. The author will examine the application of the elements of a criminal act due to negligence in a traffic accident that resulted in the death of another person, besides that through a normative approach the author tries to assess the suitability of the basic legal considerations of the Panel of Judges in imposing a crime against the defendant in the decision. Purwokerto District Court Number: 205/Pid.Sus/2018/PN Pwt., in accordance with the objectives of criminal law, both regulated in the legislation and in the literature review. The findings obtained from this study are that the panel of judges who examined, tried and decided this case had applied the applicable legal rules in accordance with the provisions of the applicable criminal law. This can be shown by seeing that the panel of judges in deciding that the defendant's actions met the elements of the crime of traffic negligence in accordance with Article 310 paragraph (4) of the Republic of Indonesia Law no. 22 of 2009 concerning Road Traffic and Transportation, is based on the material truth obtained from the indictment, witness statements, facts and evidence revealed in the trial process. Th e judge's legal considerations in the decision Number 205/Pid.Sus/2018/PN Pwt., based on the facts that emerged at the trial, considered that the defendant could be held accountable for the actions he had committed with the consideration that at the time of committing the act the defendant was negligent which resulted in a traffic accident and resulting in the death of another person. There is an element of being against the law, and there is no reason for the elimination of errors. |
