| Abstrak (Bhs. Indonesia) | Hubungan antara Pemerintah Pusat dengan Pemerintah Daerah memiliki beberapa dimensi. Beberapa di antaranya adalah hubungan kewenangan dan hubungan pengawasan. Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja, dalam beberapa ketentuan pasal mengatur hubungan kewenangan dan pengawasan tersebut, terutama kewenangan Pemerintah Pusat dalam pengawasan produk hukum daerah. Penelitian ini hendak menganalisis dasar kewenangan Pemerintah Pusat dalam pengawasan produk hukum daerah. Lebih jauh, penelitian ini hendak menganalisis implikasi yuridis Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja terhadap kewenangan Pemerintah Pusat dalam pengawasan produk hukum daerah. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan konseptual, pendekatan historis, dan pendekatan perundang-undangan. Hasil penelitian menunjukkan bahwa, yang menjadi dasar kewenangan pemerintah pusat dalam pengawasan produk hukum daerah berangkat dari konsep negara kesatuan, yang pada prinsipnya bersusun tunggal. Pemerintah pusat dalam negara kesatuan, untuk itu mempunyai kekuasaan atau wewenang tertinggi dalam segala lapangan pemerintahan. Selanjutnya, implikasi yuridis dari UU Cipta Kerja dapat kita temukan pada Pasal 176 dan Pasal 181. Pasal 176 UU Cipta Kerja merupakan bentuk tindak lanjut dari Putusan MK No. 137/PUU-XIII/2015 dan Putusan MK No. 56/PUU-XIV/2016, serta dilakukan penguatan mekanisme preview oleh pemerintah pusat terhadap suatu rancangan peraturan daerah. Pasal 181 UU Cipta Kerja memiliki implikasi, berupa potensi memunculkan dualisme kewenangan terhadap pengujian Peraturan Daerah. |

| Abtrak (Bhs. Inggris) | The relationship between the Central Government and Local Government has several dimensions. Some of these are authority relations and supervisory relations. Law Number 11 of 2020 concerning Job Creation, in several provisions of the article regulates the relationship of authority and supervision, especially the authority of the Central Government in the supervision of regional legal products. This study wants to analyze the basis of the central government's authority in supervising regional legal products. Furthermore, this study wants to analyze the juridical implications of Law Number 11 of 2020 concerning Job Creation on the authority of the Central Government in supervising regional legal products. This research uses normative juridical methods with a conceptual approach, historical approach, and statutory approach. The results showed that, which became the basis for the authority of the central government in the supervision of regional legal products departed from the concept of a unitary state, which is the basis of the authority of the central government in the supervision of regional legal products departs from the concept of a unitary state, which in principle is single-composed. The central government in a unitary state, therefore has the highest power or authority in all areas of government. Furthermore, the juridical implications of the Job Creation Law can be found in Article 176 and Article 181. Article 176 of the Job Creation Law is a follow-up to the Constitutional Court Decision Number 137/PUU-XIII/2015 and the Constitutional Court Decision Number 56/PUU-XIV/2016, as well as strengthening the preview mechanism by the central government on a draft regional regulation. Article 181 of the Job Creation Law has implications, in the form of the potential to give rise to dualism of authority over the testing of Regional Regulations. |
